PATENTS ACT 1990 No. 83, 1990 - SECT 166

Previous agreements inoperative
166. An agreement or licence (whether made or given before or after the
commencement of this Act) fixing the terms on which a person other than the
Commonwealth or a State may exploit an invention is inoperative with respect
to the exploitation, after the commencement of this Act, of the invention
under subsection 163 (1), unless the agreement or licence has been approved:

   (a)  if the relevant authority is the Commonwealth - by the Minister; or

   (b)  if the relevant authority is a State - by the Attorney-General of the
        State.
