PATENTS AMENDMENT ACT 1984 No. 92, 1984 - SECT 6

6. Section 131 of the Principal Act is amended-

   (a)  by inserting after sub-section (1) the following sub-section:



"(1A) Subject to any directions of the Minister, the Commissioner may, if it
appears to him to be necessary or expedient to do so in the interests of the
defence of the Commonwealth, by order in writing under his hand, prohibit or
restrict access to a micro-organism deposited for the purposes of section 40
with a prescribed depositary institution situated in Australia, whether
generally or to a particular person or to the persons included in a class of
persons.";

   (b)  by adding at the end of sub-section (2) "or give a person access to a
        micro-organism in contravention of an order made under sub-section
        (1A)";

   (c)  by inserting in sub-section (5) ", or the giving of access to a
micro-organism," after "an invention"; and

   (d)  by adding at the end thereof the following sub-section:



"(6) A reference in this section to giving access to a micro-organism includes
a reference to furnishing a sample of the micro-organism.".
