RADIOCOMMUNICATIONS ACT 1992 No. 174, 1992 - SECT 200

Imputed knowledge
200. For the purposes of establishing a contravention of section 192, 193 or
194, paragraph 195(1)(b) or section 199, if, having regard to:

   (a)  a person's abilities, experience, qualifications and other attributes;
        and

   (b)  all the circumstances surrounding the alleged contravention; the
        person ought reasonably to have known that using the transmitter in
        question, or doing the act or thing in question, was a contravention
        of that provision, the person is taken to have known that using the
        transmitter, or doing the act or thing, was such a contravention.
