RADIOCOMMUNICATIONS ACT 1992 No. 174, 1992 - SECT 305
Evidentiary certificates
305.(1) A Commonwealth officer who holds such qualifications as are specified
in the regulations may issue a certificate, signed by the officer, setting out
such facts as he or she considers relevant with respect to:
(a) his or her qualifications; and
(b) an examination he or she has made of a device.
(2) A certificate purporting to be issued under subsection (1) and to be duly
signed is, in proceedings under or arising out of this Act or the Customs Act
1901 , prima facie evidence of the facts stated in it.
(3) The SMA may issue a certificate, signed by a person authorised by the SMA
for the purposes of this subsection, stating that at a specified time, or
during a specified period, a specified person was, or was not, the holder of a
specified kind of radiocommunications instrument.
(4) A certificate purporting to be issued under subsection (3) and to be duly
signed is, in proceedings under or arising out of this Act, prima facie
evidence of the facts stated in it.
(5) In this section:
"radiocommunications instrument" means a licence, certificate or permit issued
under this Act, and includes a permission issued under section 174.
