SUPERANNUATION ACTS AMENDMENT ACT 1978 No. 17, 1978 - SECT 55

55. Section 145 of the Principal Act is amended-

   (a)  by omitting from paragraph (c) of sub-section (7) ''and'';

   (b)  by omitting from sub-paragraph (i) of paragraph (d) of sub-section (7)
        ''and'';

   (c)  by omitting sub-paragraph (ii) of paragraph (d) of sub-section (7) and
        substituting the following sub-paragraphs:

''(ii) pay to him out of the Superannuation Fund an amount equal to his
accumulated supplementary contributions; and

''(iii) pay out of the Superannuation Fund and into the Consolidated Revenue
Fund an amount equal to the amount that, but for this Part, would have been
payable to the former contributor under section 80 less any amounts paid to
him under sub-paragraphs (i) and (ii) of this paragraph; and'';

   (d)  by adding at the end of sub-section (7) the following paragraph:

''(e) section 112 does not apply in relation to the former contributor.'';

   (e)  by omitting sub-paragraph (i) of paragraph (a) of sub-section (8) and
        substituting the following sub-paragraph:

''(i) pay into the Superannuation Fund an amount equal to the amount that, but
for sub-section (2), would have been paid by the Commissioner into the
Superannuation Fund and the amount of any interest that, in accordance with
the regulations, is payable in respect of that amount;''; and

   (f)  by omitting sub-paragraph (i) of paragraph (a) of sub-section (9) and
        substituting the following sub-paragraph:

''(i) pay into the Superannuation Fund an amount equal to the amount that, but
for sub-section (2), would have been paid by the Commissioner into the
Superannuation Fund and the amount of any interest that, in accordance with
the regulations, is payable in respect of that amount;''.
