STATES GRANTS (UNIVERSITIES) ACT 1976 No. 13, 1976 - SECT 16

Grants for expenditure on University building projects, &c.
16. (1) In relation to each University specified in Column 1 of Schedule 5,
there is payable to the State in which the University is situated, for the
purpose of financial assistance in relation to a building project specified in
relation to the University in Column 2 of that Schedule, the amount specified
in relation to that project in Column 3 of that Schedule.

(2) Subject to sub-section (3), where the Commission approves a project of a
University under section 4, there is payable to the State in which the
University is situated, for the purpose of financial assistance in relation to
that project, an amount equal to the amount of expenditure approved by the
Commission under sub-section 4 (3) in respect of that project.

(3) The respective totals of the amounts payable to the States under
sub-section (2) in the year 1976 shall not exceed-

   (a)  in the case of amounts for the purpose of financial assistance in
        relation to building projects referred to in paragraph 4 (1) (a) that
        are approved under sub-section 4 (2)-$1,596,000;

   (b)  in the case of amounts for the purpose of financial assistance in
        relation to projects for the provision of teaching facilities at
        community health centres, being projects referred to in paragraph 4
        (1) (b), that are approved under sub-section 4 (2)-$300,000; and

   (c)  in the case of amounts for the purpose of financial assistance in
        relation to projects for planning the erection, alteration or
        extension of buildings or other facilities, being projects referred to
        in paragraph 4 (1) (c), that are approved under sub-section 4
        (2)-$800,000.

(4) Where the Minister is satisfied that-

   (a)  the amount specified in Column 3 of Schedule 5 in relation to a
        building project of a University exceeds, or is likely to exceed, the
        cost of the project;

   (b)  the amount specified in paragraph (3) (a) exceeds, or is likely to
        exceed, the total cost of all projects referred to in paragraph 4 (1)
        (a) that are approved under sub-section 4 (2);

   (c)  the amount specified in paragraph (3) (b) exceeds, or is likely to
        exceed, the total cost of all projects referred to in paragraph 4 (1)
        (b) that are approved under sub-section 4 (2); or

   (d)  the amount specified in paragraph (3) (c) exceeds, or is likely to
        exceed, the total cost of all projects referred to in paragraph 4 (1)
        (c) that are approved under sub-section 4 (2), the Minister may direct
        that the amount so specified shall be deemed to be reduced by such
        amount as is specified by the Minister.

(5) Where the Minister gives a direction under sub-section (4), the Minister
may direct that another amount or other amounts specified in Schedule 5 or
sub-section (3) shall be deemed to be increased by such specified amount or by
such specified amounts as the Minister considers necessary in consequence of
that direction.

(6) A direction shall not be given under sub-section (5) if the effect of the
direction and of the direction given under sub-section (4) in consequence of
which it was given would result in the sum of the amounts available to the
States by way of financial assistance under this section exceeding
$51,600,000.

(7) Where the Minister gives a direction under sub-section (4) or (5), this
Act has effect as if the amounts referred to in the direction had been
respectively reduced or increased, as the case may be, in accordance with the
Minister's direction.

(8) Where a project specified in Schedule 5 consists of, or includes, the
erection, alteration or extension of a building, that project shall be deemed
to include the provision of furnishings, as approved by the Commission for the
purposes of this section, for that building, or for the altered parts or the
extensions of that building, as the case may be.

(9) The financial assistance to a State by way of payment of an amount under
this section in relation to a project of a University is granted on the
conditions that-

   (a)  the State will, without undue delay, pay that amount to the
        University; and

   (b)  the State will ensure that the amount so paid to the University is
        applied by the University, without undue delay, towards the carrying
        out of that project.
