SUPERANNUATION (RESOLUTION OF COMPLAINTS) ACT 1993 No. 80, 1993 - SECT 39

Reference of questions of law to Federal Court
39. (1) The Tribunal may, on its own initiative or on the request of a party,
refer a question of law arising in relation to a complaint to the
Federal Court for decision.

(2) The Federal Court has jurisdiction to hear and determine a question of law
referred to it under this section.

(3) If a question of law in relation to a complaint has been so referred to
the Federal Court, the Tribunal must not:

   (a)  make a determination to which the question is relevant while the
        reference is pending; or

   (b)  do anything that is inconsistent with the opinion of the Federal Court
        on the question.
