TELECOMMUNICATIONS ACT 1991 No. 98 of 1991 - SECT 379

Disclosure of interests
379. (1) A member who has a direct or indirect pecuniary interest in a matter
being considered by AUSTEL must, as soon as possible after the relevant facts
have come to the member's knowledge, disclose the nature of the interest at a
meeting of AUSTEL.

(2) A disclosure must be recorded in the minutes of the meeting and the member
must not, unless the Minister or AUSTEL otherwise determines:

   (a)  be present during any deliberation by AUSTEL about that matter; or

   (b)  take part in any decision of AUSTEL relating to that matter.

(3) For the purpose of AUSTEL making such a determination in relation to a
member who has made a disclosure, a member who has a direct or indirect
pecuniary interest in the matter to which the disclosure relates must not:

   (a)  be present during any deliberation by AUSTEL for the purpose of making
        the determination; or

   (b)  take part in making the determination.
