CHILD SUPPORT (REGISTRATION AND COLLECTION) (OVERSEAS-RELATED MAINTENANCE OBLIGATIONS) REGULATIONS 2000 2000 NO. 80 - REG 18
Effect of child support assessment
- (1)
- A registered maintenance liability that is an agency reimbursement
liability or a liability mentioned in subregulation 11 (1) ( liability first
registered ) ceases to have effect if:
- (a)
- the Registrar makes a child
support assessment in relation to the child to whom the liability first
registered relates; and
- (b)
- the liability arising under the child support assessment is registered
under the Act ( liability subsequently registered ); and
- (c)
- the payer and the person who has the care of the child under the liability
first registered are the same as the payer and the payee, respectively, under
the liability subsequently registered.
- (2)
- However, the liability first registered continues to have effect for the
purpose of collecting any amount that is in arrears under it.
