1985 No. 114 DEFENCE (INQUIRY) REGULATIONS - REG 36

Report of Board
36. (1) Subject to sub-regulation (2), where the President of a Board of
Inquiry is satisfied that all information relevant to the inquiry that is
practicable to obtain has been obtained, the President shall prepare a
document, to be signed by each member of the Board, setting out-

   (a)  the findings of the Board; and

   (b)  if the Board is empowered to make recommendations-any recommendations
        arising from those findings that the Board thinks fit to make, to be
        the report of the Board.

(2) Where the members of a Board of Inquiry cannot agree on a document
prepared under sub-regulation (1), each member of the Board shall make a
statement in writing, to be signed by that member, of-

   (a)  the findings made by that member; and

   (b)  if the Board is empowered to make recommendations-any recommendations
        arising from those findings that that member may think fit to make,
        and those statements shall constitute the report of the Board.

(3) The report of a Board of Inquiry shall be furnished to the appointing
authority and where the appointing authority comprises 2 or more persons a
signed copy of the report shall be furnished to each of those persons.

(4) Where a report or a copy of a report of a Board of Inquiry is furnished
under this regulation, it shall be accompanied by a copy of-

   (a)  the transcript or other record of any oral evidence taken; and

   (b)  any documents received by the Board and accepted as evidence, during
        the course of the inquiry.
