1985 No. 114 DEFENCE (INQUIRY) REGULATIONS - REG 53
Evidence by members of the Defence Force
53. (1) A member of the Defence Force may, for the purpose of assisting an
inquiry being conducted by a Court of Inquiry, be ordered by the Court to give
evidence or to produce a document or article.
(2) An order under sub-regulation (1) shall not require a member of the
Reserve Forces to appear before a Court of Inquiry at a time when the member
is not on duty.
(3) For the purposes of sub-regulation (2), a member of the Reserve Forces
shall be deemed to be on duty from the time appointed for that member to
report or to attend at a specified place for any naval service, military
service or air force service that the member is required by or under the
Defence Act 1903, the Naval Defence Act 1910 or the Air Force Act 1923 to
render until the member is duly released or discharged from that service.
