1996 No. 316 FISHING LEVY (ALL FISHERIES) REGULATIONS - REG 4.06

4.06. (1) This regulation applies to an ETBF fishing permit granted in the
financial year beginning on 1 July 1996 if, in the financial year beginning on
1 July 1995, the holder:

   (a)  was not granted a fishing permit authorising the use of a boat for
        fishing for tuna in the area of the East Coast Tuna Fishery; but

   (b)  did hold an existing fishing permit authorising the use of a boat for
        fishing for tuna in the area.

(2) The amount of levy for the permit is:

   (a)  if the permit allows fishing in only 1 sector of the Fishery - the
        amount specified in column 3 of the item in Part 3 of Schedule 1 for
        the sector; or

   (b)  if the permit allows fishing in 2 or more sectors of the Fishery - the
        higher or highest of the amounts specified in column 3 of the item or
        items in Part 3 of Schedule 1 for the sector or sectors; or

   (c)  if the permit is one to which regulation 4.05 also applies - the
        amount under that regulation.
