A Bill for

An Act to amend the Crimes Act 1900 in relation to police pursuits; and to amend the
Criminal Procedure Act 1986 and the Road Transport (General) Act 2005
consequentially.
Clause 1      Crimes Amendment (Police Pursuits) Bill 2010




The Legislature of New South Wales enacts:                                1

 1    Name of Act                                                         2

           This Act is the Crimes Amendment (Police Pursuits) Act 2010.   3

 2    Commencement                                                        4

           This Act commences on the date of assent to this Act.          5

Schedule 1             Amendment of Crimes Act 1900 No 40                                1

      Section 51B                                                                        2

      Insert after section 51A:                                                          3

     51B     Police pursuits                                                             4

             (1)    The driver of a vehicle:                                             5
                     (a) who knows that police officers are in pursuit of the vehicle    6
                           and that the driver is required to stop the vehicle, and      7
                    (b) who does not stop the vehicle, and                               8
                     (c) who then drives the vehicle recklessly or at a speed or in a    9
                           manner dangerous to others,                                  10
                    is guilty of an offence.                                            11
                    Maximum penalty:                                                    12
                     (a) in the case of a first offence--imprisonment for 3 years, or   13
                    (b) in the case of an offence on a second or subsequent             14
                           occasion--imprisonment for 5 years.                          15

             (2)    In this section, vehicle has the same meaning as it has in          16
                    section 52A.                                                        17
