Explanatory note
This explanatory note relates to this Bill as introduced into Parliament.
Overview of Bill
The object of this Bill is to impose a moratorium on the declaration of additional
marine parks or the expansion of sanctuary zones within existing marine parks.
Outline of provisions
Clause 1 sets out the name (also called the short title) of the proposed Act.
Clause 2 provides for the commencement of the proposed Act on the date of assent
to the proposed Act.
Schedule 1 Amendment of Marine Parks Act 1997
Schedule 1 [1] prevents the Governor from making a proclamation declaring an area
to be a marine park during the period of 5 years commencing on the commencement
of the proposed Act.

Explanatory note
Schedule 1 [3] prevents the Governor from making a regulation that would extend
the area within a marine park that comprises a sanctuary zone during the period of
5 years commencing on the commencement of the proposed Act. Schedule 1 [2]
makes a consequential amendment.

A Bill for
An Act to amend the Marine Parks Act 1997 to impose a moratorium on the

Insert after section 6 (5): 4
(6) A proclamation declaring an area to be a marine park may not be 5
made during the period of 5 years commencing on the 6
commencement of the Marine Parks Amendment (Moratorium) 7

[2] Section 17B Regulations relating to zoning plans for marine parks 9
Insert "(other than subsection (5))" after "Division" in section 17B (4). 10

(5) A regulation that classifies an area within a marine park as a 13
sanctuary zone or increases the area of a sanctuary zone within a 14
