An Act to revoke the reservation of certain land currently reserved under the National
Parks and Wildlife Act 1974 as part of Leacock Regional Park; and for other
purposes.
Clause 1 National Parks and Wildlife (Leacock Regional Park) Bill 2008
The Legislature of New South Wales enacts: 1
1 Name of Act 2
This Act is the National Parks and Wildlife (Leacock Regional Park) 3
Act 2008. 4
2 Commencement 5
This Act commences on the date of assent to this Act. 6
3 Revocation of reservation of part of Leacock Regional Park 7
(1) The reservation under the National Parks and Wildlife Act 1974 of the 8
land to which this section applies as part of a regional park is revoked. 9
(2) This section applies to an area of about 1,564 square metres, being Lot 2 10
in DP 1123827, being part of Leacock Regional Park. 11
(3) The revocation effected by this section does not affect anything done or 12
omitted to be done before the commencement of this section. 13
(4) In this section: 14
Leacock Regional Park means an area of about 34.3 hectares, being the 15
land reserved as Leacock Regional Park by notices published in the 16
following: 17
(a) Gazette No 97 of 5 September 1997 at page 7850, 18
(b) Gazette No 156 of 12 October 2001 at page 8586. 19
4 Land to vest in Minister 20
On the revocation under section 3 of the reservation as part of a regional 21
park of land to which section 3 applies, that land vests in the Minister 22
administering Part 11 of the National Parks and Wildlife Act 1974 on 23
behalf of the Crown for the purposes of that Part for an estate in fee 24
simple, freed and discharged from: 25
(a) all trusts, obligations, estates, interests, rights of way or other 26
easements, and 27
(b) any dedication, reservation, Crown grant or vesting to which the 28
land was subject, and any such dedication, reservation, grant or 29
vesting is revoked. 30
5 Saving of native title rights and interests 31
(1) This Act does not operate to extinguish any native title rights and 32
interests existing in relation to the land to which section 3 applies 33
immediately before its vesting by section 4. 34

(2) This section does not affect any extinguishment of native title rights and 1
interests by the operation of the Native Title Act 1993 of the 2
Commonwealth or the Native Title (New South Wales) Act 1994. 3
(3) Words and expressions used in this section have the same meanings as 4
they have in the Native Title Act 1993 of the Commonwealth. 5
