Use of ECM system
15 Use of ECM system
(1) Subject to a protocol established under subrule (2), and to any order or
direction of the President, a person may not use an ECM system for particular
proceedings unless the person is-- (a) a party to the proceedings, or
(b) an
Australian legal practitioner or agent representing a party to the
proceedings, or
(c) a person authorised to use the ECM system by an
Australian legal practitioner or agent representing a party to the
proceedings.
(2) The President may establish a protocol for the use of an ECM
system that applies generally or for particular proceedings.
(3) The protocol
may provide for public access to information held by the Commission, but not
to the contents of a document held by the Commission in relation to particular
proceedings.
(4) Subject to subrule (3), the protocol may provide for-- (a)
the specification of the level of access to the system to which persons
generally or persons of specified classes are entitled, and
(b) the
conditions of use of the system applicable to persons generally or persons of
a specified class.
(5) The level of access to an ECM system to which a person
is entitled, and the conditions of use that apply to a person, are subject to
any order or direction of the President.
