(1) A water supply work approval must not be granted within an area classed as having a high probability of occurrence of acid sulfate soils on an Acid Sulfate Soil Risk Map maintained by the NSW Office of Environment & Heritage.
(2) Subclause (1) does not apply to the grant or amendment of a water supply work approval if the Minister is satisfied that the location of the water supply work would not result in a significant risk of acidification of these water sources.
(3) For the purposes of subclause (2), the Minister may require the applicant to submit a hydrogeological study to demonstrate that construction of a water supply work within an area classed as having a high probability of occurrence of acid sulfate soils would not, in the Minister's opinion, result in acidification of these water sources.Notes :1
