S e c o n d l y -- W h o believe i n t h e M e s s i a h s h i p of J e s u s as t h e Son of t h e living God a n d t h e only Saviour of m e n , a n d t h a t believers i n H i m arc u n d e r t h e m o s t solemn obligations t o obey all H i s c o m m a n d s a n d r e g u l a t e t h e i r p r a c t i c e b o t h individually a n d collectively according to t h e t e a c h i n g s of J e s u s a n d H i s Apostles. T h i r d l y -- W h o reject all p a r t y designations as subversive of t h e h e a d s h i p of Christ a n d as d e s t r u c t i v e of t h e oneness of H i s body t h e C h u r c h , a n d hence a c k n o w l e d g e n o n a m e b u t those found i n t h e N e w T e s t a m e n t as Christians 'Disciples of Christ, &c. F o u r t h l y -- T h a t t h e first C h u r c h e s as set i n order in t h e days of a n d b y t h e Apostles of Christ a r c t h e only t r u e models of a C h u r c h of Christ, a n d w h o recognize n o s t a t e m e n t as a u t h o r i t a t i v e i n reference to t h e order of those C h u r c h e s b u t t h a t found i n t h e N e w T e s t a m e n t . F i f t h l y -- W h o believe, t h a t w h i l e it is t h e i r d u t y to believe all t h e facts a n d t r u t h s a n d obey all t h e c o m m a n d s f o u n d in t h e N e w T e s t a m e n t , t h e y h a v e e n t i r e l i b e r t y of j u d g m e n t i n all o t h e r matters ; And S i x t h l y -- W h o believe t h a t t h e M e s s i a h s h i p of J e s u s as t h e Son of t h e living God is t h e only t r u e basis of Christian u n i o n , t h a t t h e one body, one spirit, one hope, one L o r d , one faith, one b a p t i s m , a n d one God is t h e b o n d w i t h i n w h i c h t h e C h u r c h should be u n i t e d i n peace, a n d t h a t t h e b o n d of perfection to obtain w h i c h should b e t h e object of all t r u e believers i n love t o God a n d m a n . A n d w h e r e a s a certain c h u r c h or chapel was afterwards erected u p o n t h e said lands, a n d such c h u r c h or chapel h a s been used for t h e p u r p o s e of worship b y a c o n g r e g a t i o n professing t h e doctrines sot forth in t h e said t r u s t s . A n d w h e r e a s t h e said M a t t h e w W o o d Green, George Morrison, a n d J o h n L o c k l e y are t h e n o w surviving trustees of t h e said i n d e n t u r e . A n d w h e r e a s t h e said c h u r c h or c h a p e l erected u p o n t h e said l a n d s is i n c o n v e n i e n t for t h e purposes aforesaid, a n d t h e said l a n d s h a v e g r e a t l y increased in v a l u e . A n d w h e r e a s t h e congregation w o r s h i p p i n g i n t h e said c h u r c h or chapel is desirous t h a t t h e said lands should be sold a n d t h e proceeds of t h e sale thereof applied t o w a r d s t h e p u r c h a s e of a n o t h e r site a n d t h e erection of a n o t h e r c h u r c h or chapel t h e r e o n . A n d w h e r e a s it is i m p r a c t i c a b l e to carry such desire into effect w i t h o u t t h e sanction of P a r l i a m e n t . B e it therefore enacted b y t h e Q u e e n ' s M o s t E x c e l l e n t Majesty, b y a n d w i t h t h e advice a n d consent of the Legislative Council a n d Legislative A s s e m b l y of N e w S o u t h W a l e s i n P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of t h e same, as follows :-- 1. I t shall be lawful for t h e said M a t t h e w W o o d Green, George Morrison, a n d J o h n Lockley, or t h e survivors or survivor of t h e m , or other t h e t r u s t e e or trustees for t h e t i m e b e i n g of t h e said i n d e n t u r e of t h e twelfth day of A u g u s t , one t h o u s a n d e i g h t h u n d r e d a n d sixtyeight, i n c l u d i n g a n y t r u s t e e w h o m a y be a p p o i n t e d b y t h e S u p r e m e C o u r t in its e q u i t a b l e iurisdiction in t h e place of a n y t r u s t e e w h o m a y retire b r e t i r e from t h e t r u s t or die or b e resident o u t of t h e j u r i s d i c t i o n of t h e said Court, or m a y b e u n w i l l i n g or i n c a p a b l e to a c t i n t h e t r u s t s of t h e said i n d e n t u r e , hereinafter called t h e said t r u s t e e s , to sell a n d dispose of all t h e l a n d s m e n t i o n e d a n d p a r t i c u l a r l y described i n t h e S c h e d u l e h e r e t o b y p u b l i c a u c t i o n or p r i v a t e c o n t r a c t , e i t h e r i n one or several lots a n d u p o n s u c h t e r m s a n d conditions as to title, time., a n d m a n n e r of p a y m e n t a n d otherwise as t h e y shall d e e m expedient, a n d for s u c h prices as c a n be reasonably obtained for t h e same, w i t h p o w e r to b u y i n a t a n y sale a n d to rescind or v a r y a n y c o n t r a c t for sale a n d t o resell w i t h o u t b e i n g responsible for a n y loss occasioned by s u c h rescission a n d resale a n d to convey t h e said l a u d s w h e n sold t o t h e p u r c h a s e r or p u r chasers thereof, a n d t h e receipts in w r i t i n g of t h e said t r u s t e e s for t h e p u r c h a s e m o n e y of t h e w h o l e or a n y p a r t of t h e said l a n d s shall discharge t h e p u r c h a s e r or p u r c h a s e r s thereof from a n y obligation t o see to t h e application of t h e p u r c h a s e m o n e y paid by h i m or t h e m a n d from a n y liability in respect of t h e loss, n o n a p p l i c a t i o n , or misapplica t i o n thereof. 2. I t shall be lawful for t h e said t r u s t e e s to allow a n y p u r c h a s e r credit for t h e p a y m e n t of s u c h p a r t n o t exceeding three-fourths of t h e p u r c h a s e m o n e y p a y a b l e by h i m a n d u p o n s u c h t e r m s as to interest a n d otherwise as t h e said t r u s t e e s shall d e e m reasonable. Provided t h a t t h e l a n d in respect of t h e p u r c h a s e of w h i c h credit shall be given shall r e m a i n u n c o n v e y e d or shall by a p r o p e r m o r t g a g e w i t h full pro visions of e n t r y a n d sale a n d o t h e r u s u a l a n d proper provisions b e m a d e a security for t h e p a y m e n t of t h e b a l a n c e of t h e p u r c h a s e m o n e y i n respect of w h i c h credit shall be so given. 3. T h e said t r u s t e e s shall s t a n d possessed of t h e proceeds of a n y sale u n d e r t h e powers hereinbefore c o n t a i n e d , u p o n t r u s t i n t h e first place t o p a y t h e costs a n d expenses of a n d i n c i d e n t a l t o t h e pro c u r i n g a n d passing of this A c t , a n d i n t h e n e x t place to p a y t h e costs a n d expenses of s u c h sale a n d to a p p l y t h e b a l a n c e after m a k i n g s u c h p a y m e n t s i n t h e p u r c h a s e of o t h e r freehold lands in t h e city of Sydney, a n d in t h e erection t h e r e o n a n d i n t h e r e p a i r a n d m a i n t e n a n c e of a c h u r c h or c h a p e l t o be u s e d for t h e purposes w i t h i n a period of five years after s u c h sale, a n d t h e said t r u s t e e s shall s t a n d seised of t h e l a n d s so p u r c h a s e d a n d t h e c h u r c h or chapel t o b e erected t h e r e o n u p o n t h e same t r u s t s as a r e expressed i n t h e said i n d e n t u r e of t h e twelfth d a y of A u g u s t , one t h o u s a n d e i g h t h u n d r e d a n d sixty-eight, a n d for no o t h e r t r u s t s or purposes w h a t s o e v e r . 4. This A c t m a y be cited as t h e " C h r i s t i a n C h a p e l L a n d s Sale A c t of 1 8 8 8 . " SCHEDULE. All t h a t parcel of land situate in Elizabeth-street, in t h e parish of S a i n t Lawrence, in t h e city of Sydney : Commencing on t h e building-line of Elizabeth-street, eleven feet southerly from t h e house now in t h e occupation of Mr. J a c k s o n ; and bounded on t h e n o r t h by a line easterly and parallel to said house thirty-six f e e t ; on the north-west by a line bearing north-easterly forty-three feet eight inches ; on the north-east by a lino bearing south-easterly twenty-eight f e e t ; on t h e south-east by a line bearing south-westerly twentyseven f e e t ; on t h e east by a line bearing southerly twenty-eight feet eight inches; on t h e south by a line bearing westerly and parallel to t h e line firstly described seventy feet to E l i z a b e t h - s t r e e t ; on t h e west by the building-line of t h a t street bearing northerly thirtyeight feet eight inches to the point of commencement, be the said several dimensions a little more or less.
