[23rd July, 1888.] W H E R E A S t h r e e parcels of land, b e i n g t h o s e respectively described i n t h e First S c h e d u l e w e r e , p u r s u a n t t o t h e provisions of t h e " T r a m w a y s E x t e n s i o n A c t 1 8 8 0 , " r e s u m e d b y t h e G o v e r n o r on t h e fifth d a y of M a y , i n t h e y e a r one t h o u s a n d e i g h t h u n d r e d a n d e i g h t y t w o . A n d w h e r e a s b y reason of t h e a b a n d o n m e n t of t h e r o u t e for or i n c o n n e c t i o n w i t h w h i c h s u c h parcels of l a n d w e r e so r e s u m e d a considerable portion of t h e same is n o t r e q u i r e d , a n d i t is e x p e d i e n t t o sell so m u c h as r e m a i n s after p r o v i d i n g for a street i n lieu of Q u e e n street ( w h i c h l a s t m e n t i o n e d street i t is proposed t o close), a n d also for a n y lanes w h i c h t h e Governor, w i t h t h e advice of t h e E x e c u t i v e Council, m a y t h i n k p r o p e r t o set o u t a n d dedicate. A n d w h e r e a s i n order t o c a r r y o u t t h e aforesaid objects legislative s a n c t i o n a n d c e r t a i n powers i n f u r t h e r a n c e thereof a r e necessary. B e i t therefore e n a c t e d b y t h e Q u e e n ' s M o s t E x c e l l e n t Majesty, b y a n d w i t h t h e advice a n d consent of t h e Legislative Council a n d L e g i s l a t i v e A s s e m b l y of N e w S o u t h W a l e s i n P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of t h e s a m e , as follows : -- 1. T h i s A c t m a y b e cited as t h e " C i r c u l a r Q u a y L a n d Sale and D e d i c a t i o n A c t 1 8 8 8 . " 2. A s soon as p r a c t i c a b l e after t h e p a s s i n g of t h i s A c t t h e Commissioner for R a i l w a y s shall, i n s u b s t i t u t i o n for t h e street n o w k n o w n as Q u e e n - s t r e e t , form a n d c o m p l e t e for traffic a n e w s t r e e t according t o a p l a n t o b e a p p r o v e d b y t h e Governor, w i t h t h e advice of t h e E x e c u t i v e Council, a n d t h e M u n i c i p a l C o u n c i l of t h e city of S y d n e y , a n d t o b e deposited i n t h e office of t h e Commissioner for R a i l w a y s : Provided t h a t t h e s t r e e t so t o b e s u b s t i t u t e d i n lieu of Q u e e n - s t r e e t shall so far as possible b e set o u t , formed, a n d c o m p l e t e d so as t o o c c u p y t h e site a n d conform t o t h e respective m e a s u r e m e n t s described a n d specified i n t h e Second S c h e d u l e . 3. T h e w h o l e of t h e several portions of l a n d described i n t h e F i r s t S c h e d u l e r e m a i n i n g after g i v i n g effect t o t h e s u b s t i t u t i o n a u t h o r i z e d b y t h e n e x t p r e c e d i n g section, a n d t h e dedication of a n y lanes [ w h i c h l a n e s t h e G o v e r n o r w i t h t h e advice aforesaid is h e r e b y e m p o w e r e d t o set a p a r t a n d f o r m ] s h a l l b e sold b y p u b l i c a u c t i o n b y t h e said C o m m i s s i o n e r ; a n d for t h e p u r p o s e of c a r r y i n g o u t t h e p u r p o s e s of t h i s section t h e l a n d so directed t o b e sold shall b e d e e m e d t o b e Land n o t r e q u i r e d for R a i l w a y purposes a n d shall b e subject t o t h e provisions of t h e s e v e n t y - n i n t h a n d four following sections of t h e A c t t w e n t y - s e c o n d V i c t o r i a n u m b e r n i n e t e e n : P r o v i d e d t h a t t h e proceeds of sale of s u c h p o r t i o n s shall b e p a i d i n t o a T r u s t A c c o u n t i n t h e T r e a s u r y for a p p r o p r i a t i o n as P a r l i a m e n t m a y d i r e c t for s u c h P u b l i c W o r k s as arc u s u a l l y provided for b y L o a n . 4. U p o n t h e c o m p l e t i o n a n d o p e n i n g of t h e street so t o b e s u b s t i t u t e d for Q u e e n - s t r e e t t h e w h o l e of t h e land f o r m i n g t h e site of Queen- Queen-street is hereby declared to vest in the Commissioner for Rail ways freed and discharged from all rights of way and other rights whether exercisable on or under such street for the same estate and purposes as the several portions of land described in the First Schedule; and such land shall upon such vesting be deemed to be land not required for Railway purposes, and shall be subject to the enactments mentioned in the last preceding section. And the said Commissioner is hereby required and empowered to sell so much of the said street as shall not be necessary for the formation of lanes as hereinbefore provided. SCHEDULES. FIRST SCHEDULE. (A.) Description of land taken from the Scottish Australian Investment Company {Limited) , All that piece or parcel of land situated and being in the rear of the Australian Hotel, in the town of Sydney; bounded on the north by a reserved road or passage thirtythree feet; on the east by other land of G.R. 11. Nichols fifty-one feet; on the south by land belonging to and occupied by Daniel Egan thirty-five feet; and on the west by land of Frederick Peterson forty-eight feet. All that parcel of land lying and situate in the city of Sydney; commencing at the north-west corner of the building formerly known as the Rum Puncheon and afterwards as the Bards Legacy from the north-west corner of the grant; and bounded on the west by a reserved passage, being a line bearing south westerly fifty-five feet six inches; thence on the south by the said reserved passage fronting Messieurs Solomon's stores bearing easterly forty feet; thence south-westerly seventy-one feet nine inches; on the south by allotment number ten bearing easterly forty-four feet; on the east by a line bearing north-easterly two hundred and two links ; and on the north by a lino bearing westerly one hundred and thirty-seven links to the commencing point, be the same measurements a little more or less. Description of land taken from (B.) the Trustees of Holmes'' Estate. All that piece or parcel of land situate in the city of Sydney, parish of St. Phillip, county of Cumberland, containing twelve perches, being the whole of the land comprised in certificate of title dated fourteenth January, one thousand eight hundred and sixtyseven, registered, volume L I X , folio 172. Description of Land (C) taken from A. W. Cormack. All that piece or parcel of laud part and parcel of seventy-five and three-quarter perches granted by the Crown to Isaac Nichols, deceased, by a certain deed poll dated the first day of January, one thousand eight hundred and ten, and situate in the town of Sydney, near the public wharf; bounded towards the east by lot six (other part of the said seventy-five and three-quarter perches of land formerly the property of Messrs. Naiben and Emanuel Solomon, but now the property of ) forty-eight feet; towards the north by a reserved passage thirty-two feet; towards the west by lot one (other part of the said seventy-five and three-quarter perches of land, formerly the property of Mr. William Barnes, and now the property of ) forty-four feet; and towards the south by a line easterly thirty-three feet to the commencing point, be the same several dimensions respectively a little more or less. (D.) Description of Land taken from William Cliff and others. All that piece or parcel of land containing by admeasurement forty-two rods lying and situate in Georgc-sfrcct, in the town of Sydney, county of Cumberland, and Colony of New South W ales ; bounded on the north by Nichols' grant bearing east eighteen degrees south one hundred and ninety feet; on the front south eighteen degrees and two-thirds of a degree west sixty-four feet to the corner of Boat's Crew If ut ; on the south by a line east sixteen degrees south one hundred and ninety-eight feet ; and east by a line connecting these points ; and also all that piece or parcel of land situate, lying, and being in the parish of St. Philip, in the county of Cumberland, Colony of New South Wales, and be the hereinafter mentioned several dimensions a little more or less : Commencing at a point on the eastern side of George-street fifty-three feet six inches southerly from the Queen's wharf road leading to Circular Quay ; and bounded on the west by George-street bearing southerly sixty-four feet; on the south by a line easterly sixty-four feet nine inches ; on the east by a line bearing northerly twenty-two feet westerly two feet and again northerly forty feet, passing partly along the side of Volunteer Lane ; and on the north by lines bearing westerly twelve feet three inches, northerly two feet, and westerly forty-five feet six inches to the point of commencement. r SECOND SECOND S C H E D U L E . Description of land contained in street to be substituted for Queen-street. Commencing on the western building line of Pitt-street North at a point bearing northerly and distant about one hundred and fifty-two feet from the intersection of the said building line with a prolongation of the northern building line of Alfred-street; and bounded thence by a line bearing north-westerly one hundred and fifty-three feet; thence by a curved line bearing generally south-westerly thirty-two feet to the south-eastern building line of George-street North; thence by that building line north-easterly about ninety-two feet; thence by a curved line bearing generally easterly one hundred and sixty-two feet to the western building line of Pitt-street North aforesaid; thence by that building line bearing southerly about one hundred and thirty-six feet to the point of commencement.
