B 1. This A c t m a y be cited as t h e " Closer S e t t l e m e n t ( A m e n d m e n t ) A c t , 1 9 0 9 , " a n d shall be c o n s t r u e d w i t h t h e Closer S e t t l e m e n t Act, A c t , 1901 (hereinafter referred to as t h e P r i n c i p a l A c t ) , t h e Closer S e t t l e m e n t ( A m e n d m e n t ) Act, 1900, a n d the Closer S e t t l e m e n t ( A m e n d m e n t ) A c t , 1907. 2. I n this A c t , unless t h e c o n t e x t otherwise r e q u i r e s , -- " H o m e m a i n t e n a n c e a r e a " m e a n s area which, w h e n used for t h e p u r p o s e for which it is reasonably fitted would be sufficient for the m a i n t e n a n c e in a v e r a g e seasons a n d c i r c u m s t a n c e s of an average family. 3. The Governor, by p r o c l a m a t i o n in t h e G a z e t t e , m a y cancel or a m e n d a n y p r o c l a m a t i o n u n d e r section four or section five of t h e Closer S e t t l e m e n t ( A m e n d m e n t ) Act, 1907, as to all or any p a r t of t h e land affected t h e r e b y . PRIVATE SUBDIVISION von CLOSER SETTLEMENT. 4. (1) A t a n y t i m e after t h e date of a proclamation u n d e r section four or section five of t h e Closer S e t t l e m e n t ( A m e n d m e n t ) A c t , 1907, t h e M i n i s t e r a n d t h e o w n e r may agree t h a t a n y land, b e i n g t h e whole or part of t h e l a n d covered by t h e proclamation, shall be subdivided a n d sold or leased in such areas a n d subject to s u c h t e r m s a n d conditions as m a y he agreed u p o n . (2) Upon notification in t h e Gazette of s u c h a g r e e m e n t , t h e M i n i s t e r m a y further notify t h a t in consideration of a n d s u b j e c t to t h e fulfilment of t h e t e r m s of such a g r e e m e n t , t h e power of r e s u m p t i o n shall be s u s p e n d e d -- (a) for such period of time not exceeding t w o years, a n d (b) for such area ( b e i n g t h e whole or a n y p a r t of t h e l a n d covered by t h e proclamation) as may be agreed upon between t h e M i n i s t e r a n d t h e owner. U p o n such further notification b e i n g made, no r e s u m p t i o n of t h e land referred to therein shall be lawful u n d e r t h e provisions of t h e Closer S e t t l e m e n t Act, 1 9 0 1 , t h e Closer S e t t l e m e n t ( A m e n d m e n t ) A c t , 1900, t h e Closer S e t t l e m e n t ( A m e n d m e n t ) Act, 1907, or of this Act, u n t i l after the e x p i r y of t h e period of suspension n a m e d in such aforesaid notification. 5. A sale or lease of land m a d e u n d e r such a g r e e m e n t , a n d a n y s u b s e q u e n t sale, m o r t g a g e , transfer, or lease of s u c h land, or a n y p a r t thereof, m a d e within five years after such first-mentioned sale or lease, shall, w i t h i n a t i m e to be prescribed, or w i t h i n s u c h f u r t h e r t i m e as t h e M i n i s t e r m a y allow, he s u b m i t t e d to t h e M i n i s t e r b y one of t h e parties to t h e same. 6. On a n y sale or lease by t h e owner being so s u b m i t t e d , t h e M i n i s t e r m a y , w i t h i n one m o n t h after s u c h submission, refer t h e same to the local land b o a r d for i n q u i r y as to w h e t h e r t h e owner h a s carried o u t t h e t e r m s and conditions agreed to as aforesaid ; a n d in case it be decided that he h a s failed to fulfil the same, t h e suspension of t h e power of r e s u m p t i o n shall cease. AMENDMENT A M E N D M E N T OF C L O S E R S E T T L E M E N T A C T , 190-1. Appeals. 7. Section e i g h t e e n of t h e P r i n c i p a l A c t is a m e n d e d by a d d i n g a t t h e end thereof t h e following subsections :-- (5) W h e r e a j u d g e has b e e n a p p o i n t e d for t h e purposes of t h i s section t h e G o v e r n o r m a y , in t h e case of t h e d e a t h , illness, i n c a p a c i t y , or absence of s u c h j u d g e , or a t t h e r e q u e s t of t h e Chief J u s t i c e , or for a n y o t h e r r e a s o n a b l e cause, a t a n y t i m e a p p o i n t in t h e place of t h e j u d g e tirst m e n t i o n e d a n y o t h e r j u d g e of t h e S u p r e m e C o u r t . T h e j u d g e so a p p o i n t e d shall h a v e t h e p o w e r s a n d a u t h o r i t i e s of a j u d g e a p p o i n t e d in p u r s u a n c e of this section. (6) W h e r e a n assessor apjjointed u n d e r this section dies or becomes i n c a p a b l e of a c t i n g in his office, t h e G o v e r n o r or t h e a p p e l l a n t , as t h e case m a y be, m a y a t a n y t i m e a p p o i n t a n y person to be assessor in t h e place of t h e assessor w h o h a s died or b e c o m e i n c a p a b l e of a c t i n g as agreed. T h e person so a p p o i n t e d shall h a v e t h e p o w e r s of a n assessor a p p o i n t e d in p u r s u a n c e of this section. Applications. 8. Section t w e n t y - s i x of t h e P r i n c i p a l A c t is repealed a n d t h e following is s u b s t i t u t e d :-- 26. A n y m a l e p e r s o n n o t b e i n g u n d e r t h e age of e i g h t e e n y e a r s , a n d a n y female p e r s o n n o t b e i n g u n d e r t h e age of t w e n t y - o n e years, a n d n o t b e i n g t h e holder u n d e r a n y t e n u r e o t h e r t h a n a n n u a l t e n u r e of a n y l a n d e x c e p t -- (a) l a n d which, w h e n added to t h e a r e a applied for will not, in t h e opinion of t h e local l a n d board, s u b s t a n t i a l l y exceed a h o m e m a i n t e n a n c e area ; or (b) l a n d held as a t e n a n t from a p r i v a t e holder w i t h o u t a r i g h t of p u r c h a s e , a n d b e i n g less t h a n a h o m e m a i n t e n a n c e area, m a y a p p l y for a s e t t l e m e n t p u r c h a s e u n d e r t h i s A c t , subject to t h e following provisions :--· (c) If a n y person divests himself: of a n y l a n d for t h e p u r p o s e of so a p p l y i n g for a s e t t l e m e n t p u r c h a s e his a p p l i c a t i o n shall be disallowed u n l e s s h e has o b t a i n e d before or after such d i v e s t i n g t h e M i n i s t e r ' s c o n s e n t in w r i t i n g to s u c h a p p l i c a t i o n being made. (d) T h e p e r s o n a p p l y i n g , if a female, shall be u n m a r r i e d , or widowed ; or, if m a r r i e d , be l i v i n g a p a r t from h e r h u s b a n d u n d e r a n order for j u d i c i a l separation m a d e b y a c o u r t of competent jurisdiction : Provided that with the Minister's consent a m a r r i e d w o m a n n o t living a p a r t from h e r h u s b a n d m a v a p p l v for a s e t t l e m e n t p u r c h a s e in w h i c h case t h e l a n d s held held by h e r h u s b a n d shall be considered in e s t i m a t i n g w h e t h e r t h e area as held t o g e t h e r w i t h t h a t applied for exceeds t h e limitation of subsection (a) hereof a n d in considering a n y a p p l i c a t i o n by a m a r r i e d m a n not so living apart t h e t o t a l area held b y h u s b a n d a n d wife shall be similarly considered : P r o v i d e d t h a t , in t h e case of conflicting applications a n d subject to a n y preference g r a n t e d by or u n d e r this A c t , or t h e Closer Settle m e n t ( A m e n d m e n t ) A c t , 1900, t h e land board shall t a k e into c o n s i d e r a t i o n all l a n d s held by t h e a p p l i c a n t s , a n d m a y give preference to t h e applicant w h o is s u b s t a n t i a l l y m o s t in need of land, if h e is otherwise eligible, a n d is likelv to satisfactorily w o r k a n d develop t h e land applied for. 9. Section t w e n t y - s e v e n of t h e Closer S e t t l e m e n t Act, 1 9 0 1 , is a m e n d e d by o m i t t i n g t h e word " r e g i s t e r e d . " 1 0 . Section t w e n t y - e i g h t of t h e s a m e A c t is amended--· (a) by i n s e r t i n g after " s i m u l t a n e o u s l y " t h e words " o n t h e M o n d a y aforesaid, or, if t h a t day is a p u b l i c holiday, on t h e first business day t h e r e a f t e r . " (b) by i n s e r t i n g after " m e r i t s of eacli " t h e words " w h e t h e r conflicting or n o t . " (c) by i n s e r t i n g after " b y such board"' t h e words " N o error, u n c e r t a i n t y , omission, or m i s d e s c r i p t i o n i n a n y application for a s e t t l e m e n t p u r c h a s e , or in a n y d e c l a r a t i o n prescribed a n d m a d e in connection w i t h a n y s u c h application, shall i n v a l i d a t e t h e a p p l i c a t i o n in a n y case w h e r e t h e board is satisfied t h a t s u c h error, omission, u n c e r t a i n t y , or mis description w a s n o t wilful, or m a d e w i t h i n t e n t t o d e c e i v e ; and t h e board shall h a v e full p o w e r to a u t h o r i s e t h e correction of a n y error or omission in a n y . a p p l i c a t i o n or declaration, so as to brim* t h e same i n t o conformitv w i t h t h e s t a t u t o r y requirements. W h e r e a n y prescribed declaration has not b e e n lodged, t h e board m a y p e r m i t such omission, if n o t wilful, to be supplied. T h e provisions of t h i s section shall e x t e n d to a p p l i c a t i o n s a n d declarations m a d e before b u t n o t finally disposed of at t h e c o m m e n c e m e n t of t h i s A c t . " Postponement of payment of instalments. 1 1 . Section t w e n t y - n i n e of t h e same a c t is a m e n d e d -- (a) by o m i t t i n g t h e word " t h e r e o n " in p a r a g r a p h (a) a n d i n s e r t i n g in lieu thereof t h e words " on t h e a m o u n t o w i n g from t i m e to t i m e " a n d (b) by a d d i n g a t t h e end thereof t h e following subsections :-- (2) P r o v i d e d t h a t w i t h respect to a s e t t l e m e n t p u r c h a s e m a d e a f t e r t h e n i n e t e e n t h day of D e c e m b e r , one t h o u s a n d n i n e h u n d r e d a n d seven, t h e p a y m e n t of t h e i n s t a l m e n t d u e at t h e end of t h e first year y e a r from t h e d a t e of application for t h e p u r c h a s e m a y he postponed by t h e M i n i s t e r on application b e i n g m a d e to him. P a y m e n t of a n y o t h e r i n s t a l m e n t m a y also be so p o s t p o n e d on t h e p u r c h a s e r satisfying t h e M i n i s t e r of his inability to pay it. W i t h respect to a s e t t l e m e n t p u r c h a s e m a d e before t h e said day, t h e p a y m e n t of a n y i n s t a l m e n t m a y b e postponed as aforesaid, on t h e p u r c h a s e r satisfying t h e M i n i s t e r of his i n a b i l i t y to p a y i t : P r o v i d e d t h a t n o t m o r e t h a n two s u c h p a y m e n t s shall r e m a i n postponed a n d u n p a i d u n d e r this section in respect of a s e t t l e m e n t p u r c h a s e , w h e t h e r m a d e before or after t h e n i n e t e e n t h day of December, one t h o u s a n d n i n e h u n d r e d a n d seven. I n e i t h e r such case t h e p o s t p o n e m e n t of a n y such p a y m e n t shall, unless t h e M i n i s t e r otherwise d e t e r m i n e s , be on condition t h a t i m p r o v e m e n t s to t h e v a l u e of t h e a m o u n t of any i n s t a l m e n t t h e p a y m e n t of w h i c h h a s been postponed shall be m a d e on t h e land w i t h i n t w e l v e m o n t h s after t h e d a t e of t h e p o s t p o n e m e n t . Such p o s t p o n e m e n t shall also be subject to such o t h e r conditions as t h e Minister m a y impose. T h e i m p r o v e m e n t s aforesaid shall be in addition to those r e q u i r e d by t h e P r i n c i p a l A c t or a n y A c t a m e n d i n g t h e s a m e . "Where a n y such p o s t p o n e m e n t has been g r a n t e d interest shall be c h a r g e d each y e a r at t h e r a t e of four p e r c e n t u m per a n n u m on t h e a m o u n t ( i n c l u d i n g unpaid interest) o w i n g at t h e end of t h e p r e c e d i n g y e a r ; a n d t h e b a l a n c e of p u r c h a s e m o n e y a n d interest, o w i n g a t t h e end of t h e t h i r t y - s e v e n t h year after t h e a p p l i c a t i o n for t h e p u r c h a s e shall, t o g e t h e r w i t h interest t h e r e o n , be paid as follows : (a) W h e r e p a y m e n t of one i n s t a l m e n t has been postponed, by one p a y m e n t at t h e end of t h e t h i r t y - e i g h t h y e a r after the a p p l i c a t i o n for t h e p u r c h a s e ; (b) W h e r e t h e p a y m e n t of two i n s t a l m e n t s has been postponed, by t w o e q u a l p a y m e n t s at t h e end of t h e t h i r t y - e i g h t h a n d t h i r t y - n i n t h y e a r s after t h e a p p l i c a t i o n for t h e p u r c h a s e . B u t t h e p o s t p o n e m e n t of t h e p a y m e n t of a n y i n s t a l m e n t shall cease u p o n t h e non-fulfilment of a n y condition a t t a c h e d to s u c h postponement. ( 3 ) A n y holder of a s e t t l e m e n t p u r c h a s e m a y , at a n y t i m e prescribed for t h e p a y m e n t of any i n s t a l m e n t in respect of his p u r c h a s e , p a y , in addition to t h e a m o u n t of t h e i n s t a l m e n t , t h e whole or a n y p a r t of a n y o t h e r i n s t a l m e n t not t h e n d u e ; w h e r e u p o n interest on t h e a m o u n t of such p a y m e n t shall cease to be c h a r g e d . Restrictions on purchase or transfer. 12. Section t h i r t y of t h e s a m e Act is a m e n d e d by a d d i n g t h e following at t h e end of t h e section :-- ( 3 ) I f t h e said person does n e t become so qualified w i t h i n s u c h period or f u r t h e r period, t h e M i n i s t e r m a y invite applications from from qualified persons w h o desire to a c q u i r e t h e s e t t l e m e n t p u r c h a s e , a n d m a y a p p r o v e of a n y one of s u c h a p p l i c a t i o n s , a n d m a y , on behalf of t h e person on w h o m t h e s e t t l e m e n t p u r c h a s e h a s devolved as aforesaid, sell s u c h s e t t l e m e n t p u r c h a s e to a n y person so qualified at a price a n d u p o n conditions to he d e t e r m i n e d b y t h e M i n i s t e r . T h e person u p o n w h o m t h e s e t t l e m e n t p u r c h a s e h a s devolved shall, upon p a y m e n t to h i m of t h e p u r c h a s e m o n e y , t r a n s f e r t h e s e t t l e m e n t p u r c h a s e to t h e p e r s o n whose a p p l i c a t i o n h a s been a p p r o v e d ; failing such t r a n s f e r the s e t t l e m e n t p u r c h a s e shall be forfeited. 13. Section t h i r t y - o n e of t h e s a m e A c t is a m e n d e d b y o m i t t i n g t h e words " before g r a n t . " 14, Section t h i r t y - f o u r of t h e same A c t is a m e n d e d by a d d i n g . t h e following a t t h e end of t h e section :--·" A l l g r a n t s of l a n d issued ' u n d e r t h e a u t h o r i t y of t h e Closer S e t t l e m e n t A c t s shall contain a reservation of all m i n e r a l s in s u c h land, a n d shall c o n t a i n s u c h o t h e r reservations a n d e x c e p t i o n s as m a y b y t h e Governor be deemed e x p e d i e n t in t h e p u b l i c interest." AMENDMENT OF CLOSER SETTLEMENT (AMENDMENT) ACT, 1906. 1 5 . Section t h r e e of t h e Closer S e t t l e m e n t ( A m e n d m e n t ) Act, 1 9 0 0 , is a m e n d e d -- (a) by i n s e r t i n g t h e following subsection n e x t after subsection one :-- ( 1 A ) T h e M i n i s t e r m a y allow-- (a) a n y person w h o is not a lessee as aforesaid, b u t w h o holds a n y p a r t of such land on t e r m s of s h a r i n g profits w i t h his landlord (hereinafter referred to as a s h a r e - f a r m e r ) ; or (b) a n y person employed on s u c h land, a n d who has established his h o m e and resided on a n y p a r t thereof for a t least t w o years, to r e m a i n in occupation of such p a r t of t h e l a n d a c q u i r e d for such period a n d u p o n s u c h t e r m s as he t h i n k s fit. (b) in subsection t w o by i n s e r t i n g after " t e n a n c y " t h e words " o r o c c u p a t i o n " ; b y i n s e r t i n g after " t e n a n t " t h e words " s h a r e - f a r m e r or employee " ; a n d by a d d i n g , at t h e end of t h e subsection, t h e words " i f t h e l a n d b o a r d after i n q u i r y reports t h a t he is otherwise qualified and likely to satisfactorily w o r k a n d develop t h e l a n d . " 16. Section five of t h e s a m e A c t is repealed. 17. Section seven of t h e same A c t is a m e n d e d by after " r e v o k e " t h e words " a l t e r or m o d i f y . " inserting AMENDMENT AMENDMENT OF CLOSER SETTLEMENT (AMENDMENT) ACT, 1 9 0 7 . 1 8 . Section t h r e e of t h e Closer S e t t l e m e n t ( A m e n d m e n t ) Act, 1 9 0 7 , is a m e n d e d by o m i t t i n g t h e words in p a r a g r a p h (a) w i t h i n b r a c k e t s , " n o t being, in t h e opinion of t h e board, of a v a l u e less t h a n t e n t h o u s a n d p o u n d s , exclusive of t h e value of t h e i m p r o v e m e n t s t h e r e o n , " a n d by i n s e r t i n g in p a r a g r a p h (d) after " p r o p e r t y " t h e words " i t shall state if," a n d after " r e s i d u e " t h e words " e x c e e d s t w e n t y t h o u s a n d p o u n d s or n o t . " 1 9 . (1) Subsection one of section five of t h e same A c t is amended-- (a) b y o m i t t i n g t h e w o r d s " b y p r o c l a m a t i o n in t h e G a z e t t e " ; (b) b y i n s e r t i n g after " n o t i f y " t h e words " i n t h e G a z e t t e a list of estates situated, wholly or p a r t l y , w i t h i n fifteen miles on either side of t h e line of t h e proposed railway, w h e r e u p o n no disposition by t h e owner of a n y such estate shall o p e r a t e to defeat t h e power of t h e G o v e r n o r to r e s u m e s u c h estate or a n y p a r t thereof u n d e r t h i s A c t . S u c h p r o c l a m a t i o n shall cease to have effect after t h e e x p i r a t i o n of six m o n t h s from its date, e x c e p t as to a n y l a n d i n c l u d e d in a p r o c l a m a t i o n m a d e as hereinafter in t h i s section m e n t i o n e d : Provided that a proclamation under this paragraph m a y at a n y t i m e be rescinded or altered in whole or in p a r t by t h e M i n i s t e r by n o t i c e in t h e Gazette. W h i l e s u c h restriction is in force t h e Governor m a y , by p r o c l a m a t i o n in t h e Gazette, notify " (2) Subsection two of t h e same section is a m e n d e d b y i n s e r t i n g a t t h e end of p a r a g r a p h (b) " or w h i c h has so a c c r u e d from t h e proposed c o n s t r u c t i o n of s u c h l i n e . " 2 0 . Section nine of t h e Closer S e t t l e m e n t ( A m e n d m e n t ) Act, 1 0 0 7 , is a m e n d e d b y a d d i n g t h e following p a r a g r a p h s :-- T h e o w n e r or m o r t g a g e e shall set out in s u c h notice of appeal t h e a m o u n t w h i c h he claims as t h e value of t h e l a n d and of t h e improvements thereon. "Where such owner or m o r t g a g e e fails to set o u t t h e a m o u n t h e claims as aforesaid, t h e v a l u a t i o n of t h e advisory board shall be deemed to b e t h e fair m a r k e t value of t h e land and of t h e i m p r o v e m e n t s thereon. AMENDMENT OF ACTS OF 1 9 0 1 AND 1 9 0 G . 2 1 . (1) L a n d a c q u i r e d u n d e r t h e P r i n c i p a l A c t or a n y A c t a m e n d i n g t h e same, t o g e t h e r w i t h a n y adjacent Crown lands, m a y be set a p a r t by t h e M i n i s t e r as a s e t t l e m e n t p u r c h a s e area b y notification in t h e G a z e t t e , a n d b e m a y a t a n y t i m e in t h e like m a n n e r modify, alter, or r e v o k e such s e t t i n g a p a r t . (2) (2) Before disposal of a n y l a n d u n d e r t h e said A c t s a plan of subdivision s h o w i n g t h e areas a n d v a l u e per acre of t h e proposed s e t t l e m e n t p u r c h a s e s shall be a p p r o v e d by t h e M i n i s t e r a n d shall be t h e design plan of t h e land. ( 3 ) T h e M i n i s t e r m a y , a t a n y t i m e a n d in a n y respect, a l t e r a n y design p l a n , w h e t h e r m a d e before or after the c o m m e n c e m e n t of t h i s A c t a n d w h e t h e r t h e land affected has or h a s n o t b e e n disposed of : P r o v i d e d t h a t , if t h e l a n d h a s been disposed of, t h e consent of t h e owner shall be obtained. A f t e r m e a s u r e m e n t of t h e areas a c c o r d i n g t o t h e design thereof, t h e p l a n s m a y be approved b y t h e M i n i s t e r or a n y officer duly a u t h o r i s e d in t h a t behalf. (4) L a n d a c q u i r e d u n d e r t h e P r i n c i p a l A c t or a n y A c t a m e n d i n g t b e same a n d s u c h a d j a c e n t C r o w n l a n d s as m a y a t a n y t i m e h a v e been set a p a r t as aforesaid shall he dealt, w i t h a n d disposed of u n d e r t h e provisions of t h e said A c t s , a n d in no o t h e r way, a n y provisions of t h e Crown L a n d s A c t s to t h e c o n t r a r y n o t w i t h s t a n d i n g . (5) E v e r y such s e t t l e m e n t p u r c h a s e area shall be notified for disposal u n d e r t h e design p l a n , a n d m a y be notified in t h r e e classes, n a m e l y :-- (a) A g r i c u l t u r a l land. (b) G r a z i n g land. (c) A g r i c u l t u r a l a n d g r a z i n g land. S u c h notification shall describe t h e land a n d declare it to be available for application, and shall set o u t i n t e r alia t h e class of land, t h e conditions a n d restrictions w h i c h shall a t t a c h t h e r e t o , t h e c a p i t a l value and area of each farm w h i c h m a y comprise two separated portions. (6) A n y land within, a s e t t l e m e n t p u r c h a s e area w h i c h for a n y reason is u n s u i t a b l e for disposal u n d e r t h e provisions of t h i s Act, or of a n y A c t a m e n d i n g t h e same, m a y be disposed of by sale or lease, b y a u c t i o n or t e n d e r , u p o n such t e r m s a n d conditions as m a y be d e t e r m i n e d b y t h e Minister. A n y m o v a b l e i m p r o v e m e n t s on a n area a c q u i r e d for closer s e t t l e m e n t m a y b e disposed of in a similar m a n n e r s e p a r a t e l y from t h e land. ( 7 ) Sections twenty-five a n d t h i r t y - s e v e n of t h e Closer S e t t l e m e n t A c t , 1904, a n d section four of t h e Closer S e t t l e m e n t ( A m e n d m e n t ) Act, 190G, are repealed. 2 2 . (1) T h e holder of a s e t t l e m e n t p u r c h a s e m a y , w i t h t h e consent of t h e M i n i s t e r sell a n y p a r t of t h e l a n d i n c l u d e d in s u c h p u r c h a s e as a site for a c h u r c h , school of a r t s , or c e m e t e r y , or for a n y purpose approved by the Minister. (2) On such s a l e -- (a) t h e land so sold shall cease to form p a r t of t h e s e t t l e m e n t p u r c h a s e , a n d t h e provisions of a n y A c t so far as t h e y r e l a t e to s e t t l e m e n t purchases shall cease to a p p l v to i t ; a n d I (b) (b) t h e b a l a n c e of p u r c h a s e m o n e y for such land shall f o r t h w i t h be p a y a b l e to t h e C r o w n , a n d on p a y m e n t of s u c h b a l a n c e a C r o w n g r a n t of s u c h l a n d m a y be issued. GENERAL AND SUPPLEMENTAL. 2 3 . (1) T h e following provisions shall a p p l y to t h e costs of all p r o c e e d i n g s b y w a y of appeal for d e t e r m i n i n g t h e v a l u e of l a n d r e s u m e d u n d e r t h e P r i n c i p a l A c t , or a n y A c t a m e n d i n g t h e same :-- (a) W h e r e t h e v a l u e d e t e r m i n e d by t h e c o u r t h e a r i n g t h e appeal is e q u a l to or less t h a n t h e a m o u n t a t which t h e Governor h a s offered to p u r c h a s e t h e land, or where no such oifer has been m a d e , t h e a m o u n t of t h e v a l u a t i o n of t h e advisory board, t h e owner shall p a y t h e costs of t h e a p p e a l . (b) W h e r e t h e value so d e t e r m i n e d is e q u a l to or g r e a t e r t h a n t h e a m o u n t w h i c h t h e o w n e r claims as t h e value of t h e l a n d t h e C r o w n shall p a y such costs. (c) W h e r e t h e value so d e t e r m i n e d is g r e a t e r t h a n t h e a m o u n t of t h e offer or v a l u a t i o n referred to in p a r a g r a p h (a), b u t is less t h a n t h e a m o u n t of t h e claim of t h e owner aforesaid, t h e Crown shall p a y to t h e o w n e r as costs t h e a m o u n t to be fixed by m u l t i p l y i n g t h e o w n e r ' s t a x e d costs b y a fraction of w h i c h t h e n u m e r a t o r is t h e a m o u n t b y w h i c h t h e v a l u e d e t e r m i n e d b y t h e c o u r t exceeds t h e offer or v a l u a t i o n aforesaid, a n d t h e d e n o m i n a t o r is t h e difference b e t w e e n t h e a m o u n t of t h e claim of t h e o w n e r a n d t h e a m o u n t "of t h e said offer or valuation. (2) Subsection t w o of section t w e n t y - t w o of t h e P r i n c i p a l A c t is repealed. ( 3 ) P r o v i d e d t h a t t h i s section shall n o t a p p l y to proceedings in a n y s u c h appeal w h i c h h a s been c o m m e n c e d before t h e c o m m e n c e m e n t of t h i s A c t . 2 4 . W i t h t h e c o n s e n t of t h e o w n e r of a n y l a n d r e s u m e d u n d e r t h e P r i n c i p a l A c t or t h e Closer S e t t l e m e n t ( A m e n d m e n t ) A c t , 1907, t h e G o v e r n o r m a y , a t a n y t i m e , cancel s u c h r e s u m p t i o n as to t h e w h o l e or p a r t of t h e said land, or m a y modify t h e b o u n d a r i e s thereof. For t h a t p u r p o s e t h e G o v e r n o r m a y revoke a n y p r o c l a m a t i o n or notification m a d e by h i m or b y t h e M i n i s t e r u n d e r a n y s u c h A c t . 2 5 . T h e G o v e r n o r m a y m a k e r e g u l a t i o n s for t h e p u r p o s e of c a r r y i n g t h i s A c t into effect a n d p r e s c r i b i n g a n y p r o c e d u r e for t h a t p u r p o s e ; a n d in p a r t i c u l a r p r e s c r i b i n g t h e form in w h i c h a n y applica tion shall be s u b m i t t e d to t h e M i n i s t e r for his a p p r o v a l a n d t h e p a r t i c u l a r s to be t h e r e i n c o n t a i n e d ; a n d r e q u i r i n g a n d p r e s c r i b i n g t h e verification of s u c h p a r t i c u l a r s .
