An Act to increase the Duties on Colonial Spirits. [6th February, 1880.]
E it enacted by the Queen's Most Excellent Majesty by a n d with t h e advice a n d c o n s e n t of t h e L e g i s l a t i v e Council a n d L e g i s l a t i v e A s s e m b l y of N e w S o u t h W a l e s in P a r l i a m e n t assembled a n d b y t h e a u t h o r i t y of t h e s a m e as follows :-- 1. I n lieu of t h e duties n o w chargeable on Spirits m a n u f a c t u r e d in t h e Colony of N e w S o u t h W a l e s i n c l u d i n g all s u c h Spirits n o w i n bond t h e r e shall be t a k e n a n d levied o n all k i n d s of Spirits so m a n u f a c  t u r e d t h e s t r e n g t h of w h i c h c a n be a s c e r t a i n e d b y S y k e s ' H y d r o m e t e r twelve shillings t h e proof gallon. 2. E v e r y person w h o shall o n or before t h e p a s s i n g of t h i s A c t h a v e m a d e or entered i n t o a n y c o n t r a c t or a g r e e m e n t for t h e sale or delivery u p o n or a t a n y t i m e after t h e t e n t h d a y of D e c e m b e r o n e t h o u s a n d e i g h t h u n d r e d a n d s e v e n t y - n i n e of a n y Colonial m a d e Spirits w h e r e u p o n a n y a d d i t i o n a l d u t y shall be p a y a b l e u n d e r t h e provisions of t h i s A c t shall b e at liberty to a d d to t h e price c o n t r a c t e d for so m u c h m o n e y as will be e q u i v a l e n t t o t h e a d d i t i o n a l d u t y w h i c h s h a l l b y reason of sucli provisions h a v e b e e n paid or m a d e p a y a b l e on s u c h Spirits a n d shall b e e n t i t l e d b y v i r t u e of this A c t to be p a i d t h e s a m e a c c o r d i n g l y b y t h e p u r c h a s e r of s u c h Spirits a n d to sue for a n d recover t h e s a m e a g a i n s t such p u r c h a s e r Provided t h a t i n every case w h e r e t h e price c o n t r a c t e d for shall b e so a d d e d to it shall b e a t t h e option of s u c h p u r c h a s e r b y n o t i c e in w r i t i n g u n d e r his h a n d t o b e served o n t h e o t h e r p a r t y t o s u c h c o n t r a c t w i t h i n f o u r t e e n days after t h e p a s s i n g of t h i s A c t to declare t h e c o n t r a c t n u l l a n d void a n d t h e s a m e s h a l l b e n u l l a n d void accordingly. 3 . This A c t s h a l l - b e d e e m e d to h a v e c o m e i n t o force on t h e t e n t h d a y of D e c e m b e r one t h o u s a n d e i g h t h u n d r e d a n d s e v e n t y - n i n e a n d m a y be cited as t h e " C o l o n i a l Spirits D u t y A c t of 1 8 7 9 . "
