No. VII. An Act to amend the Law respecting Felons and other Offenders. [29th July, 1854.] H E R E A S doubts h a v e arisen as to w h e t h e r t h e laws r e s p e c t i n g felons a n d o t h e r offenders t r a n s p o r t e d from t h e U n i t e d K i n g d o m c a n be applied t o felons a n d o t h e r offenders convicted a n d sentenced i n t h i s Colony or w h o m a y h a v e o b t a i n e d a p a r t i a l remission of such s e n t e n c e s a n d it is e x p e d i e n t t h a t s u c h d o u b t s should be removed B e it therefore e n a c t e d b y H i s E x c e l l e n c y t h e G o v e r n o r of N e w S o u t h W a l e s w i t h t h e advice a n d consent of t h e Legislative Council t h e r e o f : -- 1. T h a t all laws ordinances r u l e s a n d r e g u l a t i o n s now in force r e s p e c t i n g felons a n d o t h e r offenders t r a n s p o r t e d from t h e U n i t e d K i n g d o m shall b e applied t o all felons or o t h e r offenders w h o h a v e b e e n or shall be convicted a n d s e n t e n c e d i n t h e said Colony. 2. T h a t as often as a n y felon or o t h e r offender convicted in t h e said Colony shall escape from lawful c u s t o d y or abscond from t h e district or o t h e r place to w h i c h u n d e r r e g u l a t i o n s or conditions in t h a t behalf m a d e h e shall be restricted a l t h o u g h a t t h e t i m e of h i s a p p r e h e n s i o n or t r i a l for such offence t h e original t e r m of s e n t e n c e m a y h a v e e x p i r e d such felon or o t h e r offender m a y n o t w i t h s t a n d i n g be a t a n y t i m e a p p r e h e n d e d t r i e d a n d convicted of s u c h escape or a b s c o n d i n g a n d shall be liable t o be dealt w i t h i n all respects as persons e s c a p i n g or absconding d u r i n g a n y subsisting sentence are or m a y b e liable t o .
