FARMERS' RELIEF (AMEND MENT) ACT. Act No. 26, 1937.
An Act to amend the Farmers' Relief Act, 1932, and certain other Acts in certain respects; to validate certain matters; and for pur poses connected therewith. [Assented to, 15th December, 1937.]

(1) T h i s A c t m a y be cited a s the " F a r m e r s ' Belief ( A m e n d m e n t ) Act, 1 9 3 7 . " (2) T h e F a r m e r s ' Relief Act, 1932-1936, as a m e n d e d by subsequent Acts, is in this A c t r e f e r r e d to a s the P r i n c i p a l Act. (3) The P r i n c i p a l Act, as amended by this Act, m a y be cited a s the F a r m e r s ' Relief Act, 1932-1937. 2 . (1) T h e P r i n c i p a l Act is a m e n d e d by o m i t t i n g from subsection one of section eight the w o r d " t h i r t y - s e v e n " a n d b y i n s e r t i n g in lieu thereof the w o r d " t h i r t y - e i g h t . " (2) Subsection one of this section shall be deemed t o h a v e commenced on the first d a y of J u l y , one thousand n i n e h u n d r e d a n d thirty-seven. 3 . (1) The P r i n c i p a l A c t is f u r t h e r a m e n d e d -- ( a ) b y o m i t t i n g subsection (3c) of section eight a n d by i n s e r t i n g in lieu thereof the following sub section :-- (3c) (a) A f a r m e r who h a s filed in the office of the B o a r d a notice disclaiming the benefits of this A c t (in t h i s subsection r e f e r r e d to as a " n o t i c e of d i s c l a i m e r " ) m a y w i t h d r a w the same u n d e r and in accordance with this subsection. K (b) BE

(b) No w i t h d r a w a l of a notice of dis claimer shall t a k e effect unless a n d u n t i l t h e consent of the B o a r d to such w i t h d r a w a l i s granted. (c) A n y f a r m e r who desires to w i t h d r a w a notice of disclaimer shall lodge, a t the office of the board,-- (i) a n i n s t r u m e n t in w r i t i n g the notice of d i s c l a i m e r ; withdrawing the

(ii) a n application for the consent of B o a r d to such w i t h d r a w a l ;

(iii) a s t a t e m e n t , verified by the s t a t u t o r y d e c l a r a t i o n of the f a r m e r , specifying the n a m e s a n d a d d r e s s e s of all p e r s o n s to whom the f a r m e r is indebted. Such documents shall n o t be lodged before t h e e x p i r a t i o n of one y e a r from the d a t e upon which the notice of disclaimer w a s filed in the office of the B o a r d . (d) W h e r e the documents r e f e r r e d to in p a r a g r a p h (c) of this subsection have been lodged a t the office of the B o a r d the B o a r d shall-- (i) publish in the Gazette, in the W e e k l y T r a d e R e p o r t , a n d in a n e w s p a p e r cir culating in the district in which t h e f a r m e r resides or in which the f a r m is situated notice of the lodgment of such documents; (ii) notify each p e r s o n or firm specified in t h e s t a t e m e n t r e f e r r e d to in s u b p a r a  g r a p h (iii) of p a r a g r a p h (c) of t h i s subsection of the receipt of t h e i n s t r u  m e n t a n d application r e f e r r e d to in sub p a r a g r a p h s (i) a n d (ii) of t h a t p a r a  graph ; (iii) indicate in each such notification a n d in such notice t h a t objections to the g r a n t ing of consent b y t h e B o a r d m a y be' lodged

lodged a t the office of the B o a r d in accordance with p a r a g r a p h (e) of this subsection. (e) Objection to the g r a n t i n g of consent by the B o a r d m a y be lodged a t the office of t h e B o a r d a t a n y time within t h r e e weeks a f t e r the d a t e of publication in the Gazette of the notice r e f e r r e d to in s u b p a r a g r a p h (i) of p a r a g r a p h (d) of this subsection by a n y p e r s o n to w h o m the f a r m e r is indebted in respect of m o n e y s advanced, goods supplied or services r e n d e r e d a f t e r the d a t e u p o n which the notice of dis claimer w a s filed in the office of the B o a r d . A n y such objection shall be accompanied by evidence t h a t the f a r m e r is indebted to the p e r s o n lodging the objection in r e s p e c t of moneys advanced, goods supplied or services r e n d e r e d after the d a t e upon which the notice of disclaimer w a s filed in the office of the B o a r d . A n y such objection m a y be w i t h d r a w n at any time by notice in w r i t i n g lodged in the office of the B o a r d . (f) W h e n an objection is lodged in the office of the B o a r d in accordance with paragraph' (e) of this subsection the B o a r d shall, unless such objection is w i t h d r a w n , refuse to g r a n " consent to the w i t h d r a w a l of the notice of dis claimer. (g) T h e B o a r d m a y g r a n t consent to the w i t h d r a w a l of the notice of disclaimer, either absolutely or subject to such t e r m s a n d con ditions as it thinks fit.

(h) F r o m the date of publication in the Gazette of the notice r e f e r r e d to in s u b p a r a  g r a p h (i) of p a r a g r a p h (d) of this subsection until the B o a r d h a s g r a n t e d or refused its con sent to the w i t h d r a w a l of the notice of disclaimer the provisions of subsection two of section nine of this Act shall, m u t a t i s m u t a n d i s , a p p l y to a n d i n respect of the f a r m e r as if he were a f a r m e r subject to this Act. (i)

(i) T h e provisions of this subsection shall a p p l y to a n d in respect of the withdrawal, a f t e r the commencement of the F a r m e r s ' Relief ( A m e n d m e n t ) Act, 1937, of notices of disclaimer w h e t h e r such notices of disclaimer were filed before or a r e filed after such commencement. (b) (i) by omitting from subsection ten of section nine the w o r d s " d a t e of the g r a n t t h e r e o f " a n d by i n s e r t i n g in lieu thereof the w o r d s " e i g h t e e n t h d a y of A p r i l , one t h o u s a n d nine h u n d r e d a n d thirty-five or from the date of the g r a n t thereof whichever is the l a t e r date"; (ii) by i n s e r t i n g at the end of subsection eleven of the same section the w o r d s " f r o m t h e e x p i r a t i o n of the period r e f e r r e d to in sub section ten of this section, applicable with respect to t h a i s t a y o r d e r . " (2) T h e F a r m e r s ' Relief A m e n d m e n t (Debts A d  j u s t m e n t ) Act, 1935, is amended by omitting p a r a g r a p h (c) of subsection one of section two. 4 . (1) No a m e n d m e n t of the F a r m e r s ' Relief Act, 1932, m a d e by a n y subsequent A c t (including this A c t ) shall be held to o p e r a t e or to h a v e o p e r a t e d so as t o release a n y p a r t y or s u r e t y to a n y bond executed a n d delivered to the F a r m e r s ' Relief B o a r d in p u r s u a n c e of section t h i r t e e n of t h a t Act w h e t h e r as originally enacted or as a m e n d e d from time to time. (2) A reference in a n y such bond executed before the commencement of this Act to the F a r m e r s ' Relief Act, 1932, or to the F a r m e r s ' Relief Act, 1932-1934, or t o t h e F a r m e r s ' Relief Act, 1932-1935, or to the F a r m e r s ' Relief Act, 1932-1936, shall as from such commencement be r e a d a n d c o n s t r u e d as a reference to the F a r m e r s ' Relief Act, 1932-1937. (3) T h e F a r m e r s ' Relief ( A m e n d m e n t ) Act, 1934, a s a m e n d e d by subsequent A c t s , is amended by o m i t t i n g section eight. (4)

(4) The Farmers' Relief Amendment (Debts Adjustment) Act, 1935, is further amended by omitting' paragraph (d) of section six.
