No. XIX. An Act to provide for the Regulation and Discipline of the Military and Naval Forces in the service of Her Majesty's Govern m e n t in N e w South Wales. [10th May, 1871.] E i t e n a c t e d b y t h e Q u e e n ' s M o s t E x c e l l e n t Majesty b y a n d w i t h t h e advice a n d c o n s e n t of t h e Legislative Council a n d Legislative A s s e m b l y of N e w S o u t h "Wales i n P a r l i a m e n t assembled a n d b y t h e a u t h o r i t y of t h e s a m e as follows :-- 1. This A c t m a y b e cited as t h e " M i l i t a r y a n d N a v a l Forces Regulation Act." 2. I n t h i s A c t unless t h e c o n t e x t shall otherwise i n d i c a t e " G o v e r n o r " m e a n s " Governor w i t h t h e advice of t h e E x e c u t i v e C o u n c i l " -- " C o m m a n d i n g Officer" t h e " Officer i n c o m m a n d of t h e M i l i t a r y or N a v a l Forces e n g a g e d u n d e r t h i s A c t " -- " F o r c e " -- t h e " M i l i t a r y a n d N a v a l Forces embodied u n d e r this A c t . " 3 . I t shall b e lawful for t h e Governor in t h e n a m e a n d on behalf of H e r Majesty to engage t h e services of a n d m a i n t a i n embodied u p o n t h e t e r m s a n d conditions hereinafter prescribed s u c h a n u m b e r of m e n t o serve i n t h e Military a n d N a v a l Forces of N e w S o u t h "Wales as t h e P a r l i a m e n t thereof shall from t i m e t o t i m e authorize a n d provide for A n d every m a n e n g a g i n g to serve as aforesaid a n d h a v i n g t a k e n a n d subscribed t h e o a t h hereinafter provided shall t h e r e u p o n a n d d u r i n g t h e c o n t i n u a n c e of his t e r m of e n g a g e m e n t b e subject to t h e provisions of t h i s A c t a n d to t h e regulations m a d e t h e r e u n d e r . 4. T h e o a t h set forth i n t h e first Schedule to t h i s A c t shall be t a k e n a n d subscribed b y every m a n u p o n e n g a g e m e n t to serve i n any M i l i t a r y or N a v a l Corps embodied u n d e r t h i s A c t before t h e Com m a n d i n g or o t h e r Commissioned Officer of t h e Corps in w h i c h h e so engages s u c h Officer h a v i n g himself previously before some J u s t i c e of t h e P e a c e t a k e n t h e O a t h of A l l e g i a n c e to H e r Majesty contained i n t h e P r o m i s s o r y O a t h s A c t of 1870 w h i c h first-mentioned oath hereinafter t e r m e d t h e o a t h of e n g a g e m e n t every s u c h Officer is hereby e m p o w e r e d t o a d m i n i s t e r A n d every o a t h of e n g a g e m e n t shall have t h e effect a t law of a w r i t t e n a g r e e m e n t w i t h H e r Majesty b i n d i n g the person t a k i n g a n d subscribing t h e same to serve in t h e p a r t i c u l a r force a n d in t h e capacity for w h i c h h e shall h a v e so e n g a g e d u n t i l he shall bo legally discharged or b e dismissed or r e m o v e d from service 0R his resignation shall h a v e been d u l y accepted. 5. E v e r y m a n w h o shall h a v e t a k e n a n d subscribed t h e o a t h of e n g a g e m e n t as aforesaid shall d u r i n g his t e r m of service a n d u n t i l such service b e legally dispensed w i t h r e m a i n subject if serving i n the M i l i t a r y Forces to t h e provisions of t h e I m p e r i a l M u t i n y A c t in force for t h e t i m e b e i n g for H e r M a j e s t y ' s A r m y a n d if serving i n t h e Naval Forces of t h e Colony (and w h e t h e r w i t h i n t h e Colony or not) to the e n a c t m e n t s a n d regulations i n force for t h e t i m e b e i n g for the discipline of H e r Majesty's N a v y A n d every m e m b e r w h e t h e r of the M i l i t a r y or N a v a l Forces aforesaid shall i n like m a n n e r d u r i n g his t e r m of service r e m a i n subject t o t h e Q u e e n ' s R u l e s a n d Regulations t h e R u l e s a n d A r t i c l e s of W a r a n d t o s u c h o t h e r orders r u l e s and regulations B regulations of w h a t e v e r n a t u r e or k i n d to w h i c h H e r Majesty's A r m y a n d N a v y are for t h e t i m e - b e i n g respectively subject so far as t h e s a m e are n o t inconsistent w i t h t h e provisions of t h i s A c t a n d t h e r e g u lations t h e r e u n d e r . G. T h e command-in-chief i n H e r Majesty's n a m e of t h e said Military a n d N a v a l Forces is h e r e b y vested i n t h e Governor or Officer a d m i n i s t e r i n g t h e G o v e r n m e n t of t h e Colony w h o is e m p o w e r e d t o exercise from t i m e t o t i m e t h e powers following t h a t is to s a y -- (1.) H e m a y appoint t h e Officers of t h e said Forces a n d issue Commissions u n d e r his h a n d a n d t h e seal of t h e Colony to such Officers a n d m a y cancel alter or suspend such Com missions. (2.) H e m a y either i n his own n a m e or b y a n y person to w h o m h e m a y delegate his a u t h o r i t y i n t h a t behalf appoint t h e W a r r a n t a n d N o n - c o m m i s s i o n e d or p e t t y Officers of t h e said Forces. (3.) H e m a y fix t h e scale of p a y a n d allowances to b e received b y all persons serving i n t h e said Forces b u t such p a y a n d allowances shall n o t exceed t h e respective s u m s a p p r o p r i a t e d b y P a r l i a m e n t for t h e said services. 7. T h e Governor m a y m a k e rules a n d r e g u l a t i o n s for t h e e m p l o y m e n t r e m o v a l or dismissal of persons e n g a g e d t o serve u n d e r this A c t for billeting c a n t o n i n g a n d furnishing t h e m w i t h c o n v e y a n c e a n d t r a n s p o r t whilst on actual service a n d for t h e enforcement of order a n d discipline a n d generally for t h e purposes of giving effect t o t h e provisions of t h i s A c t a n d m a y b y s u c h r e g u l a t i o n s impose fines for disobedience n e g l e c t or o t h e r violation of t h e s a m e n o t exceeding t h e s u m of t e n p o u n d s for each offence a n d i m p r i s o n m e n t i n default of p a y m e n t n o t exceeding seven days A n d s u c h rules a n d r e g u l a t i o n s shall b e published i n t h e Government Gazette a n d b e judicially noticed b y t h e J u d g e s in all C o u r t s w h a t s o e v e r a n d be laid before P a r l i a m e n t w i t h i n fourteen days after t h e m e e t i n g thereof if P a r l i a m e n t b e t h e n sitting a n d if n o t t h e n w i t h i n fourteen days after t h e c o m m e n c e m e n t of t h e n e x t Session thereof. 8. I t shall b e lawful for t h e Governor from t i m e t o t i m e to convene Courts of E n q u i r y a n d t o a p p o i n t a n y t h r e e or five C o m m i s sioned Officers u n d e r this A c t to be a Court of E n q u i r y for t h e purpose of i n v e s t i g a t i n g a n d r e p o r t i n g t o h i m o n a n y m a t t e r connected w i t h t h e g o v e r n m e n t or discipline of t h e Force embodied u n d e r this A c t or w i t h t h e c o n d u c t of a n y Officer N o n - C o m m i s s i o n e d W a r r a n t or P e t t y Officer or o t h e r m e m b e r of t h e said Force a n d also t o convene a t a n y t i m e a n d t o delegate power t o convene a C o u r t - m a r t i a l a n d to a p p o i n t a n y like n u m b e r of such Officers as aforesaid to constitute s u c h C o u r t for t h e purpose of h e a r i n g a n d d e t e r m i n i n g all offences c o m m i t t e d a g a i n s t t h i s A c t or t h e r e g u l a t i o n s m a d e i n p u r s u a n c e thereof P r o v i d e d t h a t it shall be lawful for t h e Governor t o a p p o i n t a n y Officer of H e r Majesty's N a v y in c o m m a n d of a n y of h e r ships of w a r t h e n b e i n g in P o r t J a c k s o n to a c t as P r e s i d e n t of a n y N a v a l C o u r t - m a r t i a l a n d to a p p o i n t in every case one of t h e said Officers to be t h e P r e s i d e n t of such C o u r t of E n q u i r y or C o u r t - m a r t i a l w h o shall i n every case forward t h e proceedings a n d sentences of t h e Court to t h e G o v e r n o r for confirmation a n d t h e same shall b y h i m be r e t u r n e d o n confirmation to t h e P r e s i d e n t for transmission to a n d record i n t h e Office of t h e A t t o r n e y General. 9. T h e r e g u l a t i o n s for t h e composition of t h e said Courts of E n q u i r y a n d C o u r t s - m a r t i a l a n d t h e m o d e s of procedure and t h e powers a n d privileges t h e r e o f shall be so far as applicable those w h i c h m a y a t t h e t i m e - b e i n g b e in force w i t h respect t o Courts of E n q u i r y a n d C o u r t s m a r t i a l in H e r M a j e s t y ' s R e g u l a r A r m y and N a v y respectively a n d which w h i c h are n o t inconsistent w i t h t h e provisions of t h i s A c t a n d t h e regulations t h e r e u n d e r a n d t h e p a y a n d allowances of officers a n d others a t t e n d i n g s u c h C o u r t s m a y be fixed b y regulations to b e m a d e b y t h e Governor. 10. N o m e m b e r of t h e said Force shall b e sentenced to d e a t h b y a n y C o u r t - m a r t i a l e x c e p t for m u t i n y desertion to t h e e n e m y or for traitorously delivering u p to t h e e n e m y a n y garrison fortress post or g u a r d or for t r a i t o r o u s correspondence w i t h t h e e n e m y . 1 1 . N o person e n g a g e d u n d e r t h i s A c t shall b e e n t i t l e d to a n y p a y or allowances whilst in confinement u n d e r t h e sentence of a n y C o u r t or d u r i n g absence from d u t y w i t h o u t leave or u n d e r a n y c h a r g e of w h i c h h e shall b e afterwards convicted b y a n y Court. 12. A l l constables a n d peace officers arc h e r e b y directed a n d r e q u i r e d t o t a k e cognizance of a n y w r i t t e n order u n d e r t h e h a n d of a C o m m a n d i n g Officer u n d e r this A c t a u t h o r i z i n g t h e a p p r e h e n s i o n of a n y deserter or absconder from a n y corps or vessel raised or c o m m i s sioned u n d e r t h i s A c t a n d his c o n v e y a n c e t o a n y place n a m e d in s u c h order a n d to aid a n d assist i n t h e e x e c u t i o n of s u c h order a n d t o lodge a n y s u c h deserter or absconder in some place of security u n t i l s u c h order c a n b e executed. 1 3 . E v e r y gaoler or keeper of a prison or gaol is h e r e b y directed a n d r e q u i r e d t o receive i n t o his custody a n y offender u n d e r s e n t e n c e of i m p r i s o n m e n t b y a C o u r t constituted u n d e r this A c t u p o n delivery t o h i m of a w a r r a n t of c o m m i t m e n t in t h e form set forth in t h e Second S c h e d u l e u n d e r t h e h a n d a n d seal of t h e P r e s i d e n t of t h e Court or of a C o m m a n d i n g Officer A n d such gaoler or k e e p e r shall k e e p s u c h offender i n a p r o p e r place of confinement w i t h or w i t h o u t h a r d labor a n d w i t h or w i t h o u t solitary confinement a c c o r d i n g t o t h e s e n t e n c e of t h e C o u r t a n d for t h e t i m e specified i n t h e said order a n d shall also receive i n t o his custody a n y absconder or deserter u p o n receipt of a n order in w r i t i n g t o t h a t effect u n d e r t h e h a n d of such C o m m a n d i n g Officer. 14. I f a n y Officer or m e m b e r of t h e said Force shall be killed or w o u n d e d i n a c t u a l service or whilst o n d u t y t h e widow or family of t h e deceased or m e m b e r s so w o u n d e d shall b e e n t i t l e d to s u c h p e n s i o n or g r a t u i t y as P a r l i a m e n t m a y provide in t h a t behalf. 15. N o tolls or d u e s shall b e d e m a n d e d from a n y Officer or m e m b e r of t h e said Force b e i n g on a c t u a l d u t y e i t h e r i n respect of himself or of a n y prisoners u n d e r c h a r g e or of a n y c o n v e y a n c e s or beasts of b u r d e n employed i n t h e service of t h e said Force p a s s i n g a n y t o l l - g a t e t u r n p i k e - r o a d bridge or ferry u n d e r a p e n a l t y u p o n a n y toll-collector d e m a n d i n g or receiving a n y s u c h toll or d u e of a s u m n o t exceeding five p o u n d s for every s u c h offence. 16. A n y person falsely a n d w i t h i n t e n t t o defraud r e p r e s e n t i n g himself t o be a n Officer or m e m b e r of t h e said Force for t h e p u r p o s e of e v a d i n g p a y m e n t of a n y toll or d u e to w h i c h h e w o u l d otherwise b e liable shall forfeit a n d p a y for every s u c h offence a s u m n o t exceeding five p o u n d s . 17. A n y person n o t b e i n g a m e m b e r of t h e said Force w h o shall be found w e a r i n g t h e u n i f o r m or a n y p a r t thereof of a n y corps of t h e said Force shall for every s u c h offence forfeit a n d p a y a p e n a l t y n o t e x c e e d i n g five p o u n d s . 1 8 . A n y person w h o h a s ceased to b e a m e m b e r of t h e said Force w h o shall refuse or n e g l e c t t o give u p on d e m a n d of t h e Officer in c o m m a n d of t h e corps or vessel to w h i c h such person belonged all a r m s a c c o u t r e m e n t s a m m u n i t i o n c l o t h i n g or a p p o i n t m e n t s or a n y public p r o p e r t y in his possession or control shall forfeit a n d p a y for every s u c h offence a s u m n o t exceeding five p o u n d s i n addition to a n y o t h e r liability or p e n a l t y he m a y h a v e i n c u r r e d in respect of t h e r e t e n t i o n of a n y of t h e said articles. D 19. 19. A n y person w h o shall k n o w i n g l y b u y t a k e i n e x c h a n g e conceal or otherwise receive a n y a r m s a c c o u t r e m e n t s c l o t h i n g appoint m e n t s a m m u n i t i o n or o t h e r p u b l i c p r o p e r t y whatsoever delivered t o a n y m e m b e r of t h e said F o r c e for his u s e or t h e u s e of a n y o t h e r m e m b e r thereof shall for every s u c h offence forfeit a n d p a y a s u m n o t exceeding twenty pounds. 20. A l l m e m b e r s of t h e said Force a r e disqualified d u r i n g t h e i r t e r m of service from v o t i n g a t elections for t h e Legislative A s s e m b l y u n d e r a p e n a l t y for every act of v o t i n g or offering to v o t e of a s u m n o t exceeding t e n p o u n d s or of i m p r i s o n m e n t n o t exceeding o n e week. 2 1 . N o proceedings of a n y C o u r t c o n s t i t u t e d or appointed u n d e r t h i s A c t shall b e set aside or d e e m e d void for w a n t of form only or be r e m o v e d b y certiorari or otherwise i n t o t h e S u p r e m e C o u r t . 22. I f a n y a c t i o n or suit shall b e b r o u g h t a g a i n s t a n y person for a n y a c t done or alleged t o b e done b y h i m in p u r s u a n c e of t h e provisions of t h i s A c t h e m a y plead i n a n s w e r t o s u c h action or suit t h e g e n e r a l issue a n d give t h i s A c t a n d t h e special m a t t e r i n evidence u n d e r s u c h plea. 2 3 . A l l penalties i n c u r r e d u n d e r t h i s A c t or r e g u l a t i o n s t h e r e u n d e r t h e m o d e of recovering w h i c h is n o t hereinbefore specified shall b e recoverable w i t h costs i n a s u m m a r y w a y before a n y J u s t i c e of t h e P e a c e i n m a n n e r directed b y t h e A c t s for t h e t i m e b e i n g i n force r e g u l a t i n g s u m m a r y proceedings before J u s t i c e s A n d t h e convicting J u s t i c e m a y i n default of i m m e d i a t e p a y m e n t of a n y s u c h p e n a l t y t o g e t h e r w i t h costs c o m m i t t h e person convicted a n d m a k i n g default to gaol for a period of n o t m o r e t h a n fourteen days or u n t i l sooner p a y m e n t A n d every p e n a l t y w h e n recovered shall b e paid i n t o t h e Consolidated R e v e n u e F u n d . SCHEDULES. FIRST SCHEDULE. I swear t h a t I will well and truly serve Our Sovereign L a d y the Queen in t h e for t h e term of years or until sooner lawfully discharged dismissed or removed and t h a t I will resist H e r Majesty's enemies and cause H e r Majesty's peace to be k e p t both on land and a t sea--and t h a t I will in all matters appertaining to my service faithfully discharge my duty according to law. So help me God. SECOND To t h e SCHEDULE. in the Colony of New South Wales and to t h e Keeper of t h e Gaol at in t h e said Colony. Whereas A.B. was this day duly convicted by Court-martial for t h a t [state offence as in conviction] and it was b y t h e said Court adjudged t h a t t h e said A . B . for his said offence should be imprisoned in t h e Gaol a t in the said Colony [and there kept to hard labor or solitary confinement] for t h e space of These are therefore to command you the said to take t h e said A . B . and him safely to convey to the Gaol a t aforesaid and there to deliver him to the Keeper thereof together with this precept A n d I do hereby command you the said Keeper of t h e said Gaol to receive the said A . B . into your custody in the said Gaol there to imprison him [and keep him to hard labor or in solitary confinement] for the space of and for your so doing this shall be your sufficient w a r r a n t .
