[7th November, 1901.] E it e n a c t e d by t h e K i n g ' s M o s t E x c e l l e n t M a j e s t y , b y a n d w i t h t h e advice a n d c o n s e n t of t h e L e g i s l a t i v e Council a n d L e g i s l a t i v e A s s e m b l y of N e w S o u t h W a l e s i n P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of t h e same, as f o l l o w s : -- 1. This A c t m a y be cited as t h e " N e g o t i a b l e I n s t r u m e n t s Procedure Act, 1901." 2. B 2. T h e A c t s m e n t i o n e d in t h e Schedule to this A c t , to t h e e x t e n t t h e r e i n expressed, arc h e r e b y repealed. 3. I n this A c t " J u d g e " m e a n s a J u d g e of t h e Court in w h i c h t h e a c t i o n is b r o u g h t . 4. N o plea shall be admissible i n a n y action to a c o u n t on a n y d i s h o n o u r e d bill, note, c h e q u e , or o t h e r order for t h e p a y m e n t of m o n e y w i t h o u t a n affidavit-- (a) of t h e t r u t h of s u c h plea ; or (b) of s u c h facts as a J u d g e m a y u n d e r t h e c i r c u m s t a n c e s deem sufficient in t h a t behalf. 5. A n y plea to a n y s u c h count filed w i t h o u t s u c h affidavit m a y be t r e a t e d as a n u l l i t y . · 6. B y leave of a J u d g e , instead of s u c h affidavit, t h e d e f e n d a n t m a y p a y into Court t h e a m o u n t of t h e plaintiff's claim or so m u c h thereof as t h e J u d g e shall a p p o i n t . 7. U p o n application on behalf of a n y d e f e n d a n t w h o has been absent from his u s u a l place of business or abode a t t h e t i m e of service of t h e s u m m o n s , a J u d g e m a y give s u c h f u r t h e r t i m e for p l e a d i n g as he deems r e a s o n a b l e . 8. I n a n y action in t h e S u p r e m e C o u r t founded u p o n a n e g o t i a b l e i n s t r u m e n t , t h e Court or a J u d g e m a y order t h a t t h e loss of s u c h i n s t r u m e n t shall n o t be set u p , p r o v i d e d a n i n d e m n i t y is given to t h e satisfaction of t h e C o u r t or J u d g e or t h e P r o t h o n o t a r y against t h e claims of a n y o t h e r person u p o n s u c h i n s t r u m e n t .
