NURSES REGISTRATION (AMENDMENT) ACT. ANNO SEXTO DECIMO ELIZABETHE II REGINE Act No. 17, 1967. An Act relating to the Nurses Registration Board and the registration of nurses under the Nurses Regis tration Act, 1953, as amended by subsequent A c t s ; for these and other purposes to amend that Act, as so amended; and for purposes connected therewith. [Assented to, 23rd March, 1967.] BE it enacted by the Queen's Most Excellent Majesty, by U and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows : -- 1. (1) This Act may be cited as the "Nurses Registra tion (Amendment) Act, 1967". (2) (2) The Nurses Registration Act, 1953, as amended by subsequent Acts and by this Act, may be cited as the Nurses Registration Act, 1953-1967. 2. The Nurses Registration Act, 1953, as amended by subsequent Acts, is amended-- (a) by inserting in section three next after the definition of "Prescribed" the following new definition : -- "Proclaimed subdivision" means an additional subdivision of the Register as established under subsection (2A) of section fifteen of this Act. (b) (i) by omitting from paragraph (e) of subsection one of section five the words "by registered general nurses and infants' nurses in the prescribed manner" and by inserting in lieu thereof the words "in the prescribed manner by registered general nurses, registered infants' nurses and nurses registered in a proclaimed subdivision in respect of which the Governor has made a declaration under paragraph (b) of section 1 5A of this Act that they are eligible to vote in elections held under this paragraph"; (ii) by omitting from paragraph (f) of the same subsection the words "by registered midwifery nurses and mothercraft nurses in the prescribed manner" and by inserting in lieu thereof the words "in the prescribed manner by registered midwifery nurses, registered mothercraft nurses and nurses registered in a proclaimed subdivision in respect of which the Governor has made a declaration under paragraph (b) of section 15A of this Act that they are eligible to vote in elections held under this paragraph"; (iii) (iii) by omitting from paragraph (g) of the same subsection the words "by registered psychiatric nurses in the prescribed manner" and by insert ing in lieu thereof the words "in the prescribed manner by registered psychiatric nurses and nurses registered in a proclaimed subdivision in respect of which the Governor has made a declaration under paragraph (b) of section 15A of this Act that they are eligible to vote in elections held under this paragraph"; (iv) by omitting subsection four of the same section and by inserting in lieu thereof the following subsection: -- ( 4 ) The members of the Board than-- other (a) the member referred to in paragraph (h) of subsection one of this section; and (b) such other members as are members of the Public Service, shall each be paid such fees as the Governor may from time to time direct. (c) (i) by inserting next after paragraph (e) of sub section two of section fifteen the following new paragraph :-- (f) where there is a proclaimed division, the Register for subdivision. sub that (ii) by inserting next after the same subsection the following new subsection :-- (2A) The Governor, on the recommenda tion of the Board, may-- (a) by proclamation published in the Gazette, establish additional sub divisions of the Register; and (b) amend or repeal any such proclama tion by a like proclamation. (d) ( d ) by inserting next after section fifteen the following new section :-- 15A. In a proclamation under subsection ( 2 A ) of section fifteen of this Act establishing an addi tional subdivision of the Register, the Governor, on the recommendation of the Board-- (a) may assign a name to that subdivision; (b) may declare that persons registered in that subdivision are eligible to vote in elections held under such one of paragraphs (e) (f) and (g) of subsection one of section five of this Act as is specified in that proclamation; (c) shall specify the class of nurses to be registered in that subdivision and the qualifications necessary for registration therein; and (d) shall specify the age which a person must have attained before such registration. (e) (i) by omitting from subparagraph (ii) of para graph (a) of subsection one of section sixteen the word "twenty-one" and by inserting in lieu thereof the word "twenty"; (ii) by omitting from subparagraph (iii) of para graph (d) of the same subsection the word "or"; (iii) by inserting at the end of paragraph (e) of the same subsection the following word and new paragraph :-- ; or (f) as a nurse of the class to which a proclaimed subdivision relates if-- (i) she has the qualifications specified under paragraph ( c ) of section 15A of this Act in respect of that subdivision; and (ii) (ii) she has attained the age specified under paragraph (d) of section 15A of this Act in respect of that subdivision; and (iii) she has passed such examina tions as the Board prescribes. (iv) by omitting from subsections two and three of the same section the words "attained the age of twenty-one years in the case of a general or midwifery nurse, the age of twenty years in the case of a psychiatric nurse, the age of nineteen years in the case of an infants' nurse, and the age of eighteen years in the case of a mothercraft nurse," wherever occurring and by inserting in lieu thereof the following words :-- "attained-- (a) in the case of a midwifery nurse-- the age of twenty-one years; (b) in the case of a general or psychiatric nurse--the age of twenty years; (c) in the case of an infants' nurse--the age of nineteen years; (d) in the case of a mothercraft nurse-- the age of eighteen years; and (e) in the case of a nurse of the class to which a proclaimed subdivision relates--the age specified, under paragraph (d) of section 15A of this Act, in respect of that subdivision,"; (f) (i) by omitting from paragraph (a) of subsection one of section seventeen the words "the pre scribed date" and by inserting in lieu thereof the words "the thirty-first day of December"; (ii) 129 Nurses Registration (Amendment). (ii) by omitting from paragraph (b) of the same subsection the words "the date so prescribed, the Board shall forthwith" and by inserting in lieu thereof the words "the thirty-first day of October in any year, the Board shall, during the month of November in that year,"; (g) by inserting next after paragraph (ei) of section twenty-three the following new paragraph : -- (eii) a nurse of the class to which a proclaimed subdivision relates unless she is registered under this A c t in that subdivision; or (h) by inserting in subsection one of section twenty-four after the word "nurse" where firstly occurring the words "and no nurse registered in a proclaimed subdivision"; (i) (i) by inserting in paragraph (a) of section thirtyone after the word "nurse" the words "or registered in a proclaimed subdivision"; (ii) by inserting in paragraph (b) of the same section after the word "nurse" the words "0r was not registered in a proclaimed sub division" ; (j) by omitting from subsection two of section thirtyfour the words "attained the age of twenty-one years in the case of a general or midwifery nurse, the age of twenty years in the case of a psychiatric nurse, the age of nineteen years in the case of an infants' nurse or the age of eighteen years in the case of a mothercraft nurse" and by inserting in lieu thereol the following words : -- "attained-- (a) in the case of a midwifery nurse--the age of twenty-one years; (b) P86115--5 (b) in the case of a general or psychiatric nurse--the age of twenty years; (c) in the case of an infants' nurse--the age of nineteen years; (d) in the case of a mothercraft nurse--the age of eighteen years; or (e) in the case of a nurse of the class to which a proclaimed subdivision relates--the age specified, under paragraph (d) of section 15A of this Act, in respect of that sub division,".
