NEWCASTLE SEWERAGE (REVESTING) ACT. Act No. 29, 1934.
An Act to provide for the revesting of certain land in the Parish of Newcastle, County of Northumberland, resumed under the Public Works Act, 1912, for the construction and maintenance of the works authorised by the Newcastle and Suburbs Sewerage Ampli fication Act, 1928. [Assented to, 9th November, 1934.]
WHEREAS by a notification of r e s u m p t i o n u n d e r a n d in p u r s u a n c e of the Public W o r k s Act, 1912, published in the G o v e r n m e n t Gazette of the t w e n t i e t h d a y of March, one t h o u s a n d nine h u n d r e d a n d thirty-two, t h e land described in the Schedule to this Act w a s , t o g e t h e r w i t h o t h e r l a n d s , r e s u m e d for a c e r t a i n public p u r p o s e , namely, the construction a n d m a i n t e n a n c e of w o r k s a u t h o r i s e d by the Newcastle a n d S u b u r b s Sewerage Amplification Act, 1928: A n d w h e r e a s it h a s been found t h a t the said land is n o t r e q u i r e d for the said p u r p o s e a n d it is desired to revest the same in the p e r s o n s who w e r e entitled t h e r e t o a t the time of the said r e s u m p t i o n : B e it t h e r e f o r e enacted b y the K i n g ' s Most Excellent Majesty, by and with the advice a n d consent of the Legis lative Council a n d Legislative Assembly of New S o u t h W a l e s in P a r l i a m e n t assembled, a n d by the a u t h o r i t y of the same, as follows :-- 1. This Act m a y be cited as the " Newcastle S e w e r a g e ( R e v e s t i n g ) Act, 1934." 2 . On the p a s s i n g of this Act, the land described in the Schedule h e r e t o shall revest in the p e r s o n s who were entitled

entitled t h e r e t o a t t h e time of such r e s u m p t i o n a s a f o r e  s a i d a n d for such e s t a t e s a n d i n t e r e s t s a n d w i t h a n d sub ject to such r i g h t s a s w e r e s u b s i s t i n g in r e s p e c t of t h e said l a n d a t t h e time of such r e s u m p t i o n , a n d such l a n d shall be subject to all t r u s t s , obligations, e s t a t e s , i n t e r  ests, c o n t r a c t s , c h a r g e s , r a t e s , r i g h t s - o f - w a y or o t h e r e a s e m e n t s f r o m which it w a s freed a n d d i s c h a r g e d b y such r e s u m p t i o n a s if t h e said l a n d h a d n o t been r e s u m e d , a n d shall also be subject to a n y i n t e r e s t s in or equities b i n d i n g on the c o m p e n s a t i o n m o n e y s c r e a t e d since t h e said r e s u m p t i o n .

SCHEDULE. ALL that piece or parcel of land situate in the parish of Newcastle, county of Northumberland, and State of New South Wales, being part of portion 26A comprised in deed registered book 144, No. 354: Com mencing within the said portion 26A at a point bearing 222 degrees 25 minutes 30 seconds and distant 265 feet 3 / inches from the western most corner of lot 9 section 8A of a subdivision of the Merewether Estate; and bounded thence on the south-east by a line bearing 194 degrees 20 minutes 46 feet 6 / inches, on the south-west generally by lines successively bearing 284 degrees 20 minutes 33 feet, 194 degrees 20 minutes 10 feet 6 inches, 284 degrees 20 minutes 33 feet, 14 degrees 20 minutes 16 feet 6 inches, and 2S5 degrees 50 minutes 83 feet 7 / inches, on the north-west by lines bearing 14 degrees 26 minutes 17 feet 4 / inches and 64 degrees 36 minutes 58 feet 6 / inches respectively; and on the north-cast by a line bearing 110 degrees 1 minute 105 feet 0 / inch, to the point of commencement, having an area of 26 / perches or thereabouts, and said to be in the possession of the estate of the late E. C. Merewether.
