Preliminary. 1. T h i s A c t m a y be cited as t h e " P r o h i b i t i o n a n d A c t , 1 9 0 1 , " a n d is divided i n t o P a r t s , as follows :-- P A R T 1.--Preliminary--ss. 1-3. P A R T 1 l . -- P r o h i b i t i o n -- ss. 4 - 7 . P A R T III.--Mandamus--ss. 8-18. 2. (1) T h e A c t m e n t i o n e d in t h e S c h e d u l e to this A c t is, to t h e e x t e n t t h e r e i n expressed, h e r e b y repealed. (2) N o t h i n g h e r e i n shall be deemed to affect t h e provisions of t h e C o m m o n L a w P r o c e d u r e A c t , 1899. 3. Mandamus B 3. I n this Act, unless t h e c o n t e x t or s u b j e c t - m a t t e r otherwise indicates or r e q u i r e s , -- " C o u r t " m e a n s t h e S u p r e m e C o u r t of N e w S o u t h W a l e s . PART II. Prohibition. 4. I t shall n o t be necessary to file a suggestion on a n y appli cation for a writ of prohibition, b u t s u c h application m a y be m a d e on affidavits only. 5. (1) I f t h e p a r t y a p p l y i n g is directed to declare in p r o h i b i t i o n before w r i t issued, s u c h declaration shall be expressed to be on behalf of s u c h p a r t y only, a n d n o t on behalf of t h e p a r t y a n d of H i s Majesty. (2) S u c h declaration shall c o n t a i n a n d set forth in a concise m a n n e r so m u c h only of t h e p r o c e e d i n g in t h e Court below as is necessary t o show t h e g r o u n d of t h e application, w i t h o u t a l l e g i n g t h e delivery of a w r i t or a n y c o n t e m p t , a n d shall conclude b y p r a y i n g t h a t a w r i t of p r o h i b i t i o n m a y issue. 6. To s u c h declaration t h e p a r t y d e f e n d a n t m a y d e m u r or plead s u c h m a t t e r s b y w a y of t r a v e r s e or o t h e r w i s e as m a y be proper to show t h a t t h e w r i t o u g h t n o t to issue, a n d c o n c l u d e b y p r a y i n g t h a t s u c h w r i t m a y n o t issue. 7. (1) J u d g m e n t shall be g i v e n t h a t t h e w r i t of prohibition do or do n o t issue, as j u s t i c e m a y r e q u i r e . (2) T h e p a r t y in whose favour j u d g m e n t is given, w h e t h e r on n o n s u i t , v e r d i c t , d e m u r r e r , or otherwise, shall be e n t i t l e d to t h e costs a t t e n d i n g t h e application a n d s u b s e q u e n t p r o c e e d i n g s , a n d h a v e j u d g m e n t to recover t h e same. (3) I f a verdict is given for t h e p a r t y plaintiff i n s u c h d e c l a r a t i o n t h e j u r y m a y assess d a m a g e s , for w h i c h j u d g m e n t shall also be given, b u t s u c h assessment shall n o t be necessary to e n t i t l e t h e plaintiff to costs. PART III. Mandamus. 8. W h e r e a writ of m a n d a m u s issues o u t of t h e Court, every person by law r e q u i r e d to m a k e a r e t u r n to such writ shall m a k e his r e t u r n to t h e first w r i t of m a n d a m u s . 9. 9. W h e r e a w r i t of m a n d a m u s issues o u t of t h e C o u r t , a n d a r e t u r n is m a d e t h e r e u n t o , t h e person s u i n g or p r o s e c u t i n g s u c h writ m a y plead to or t r a v e r s e all or a n y t h e m a t e r i a l facts c o n t a i n e d w i t h i n t h e said r e t u r n , to w h i c h t h e p e r s o n m a k i n g s u c h r e t u r n m a y reply, t a k e issue, or d e m u r , a n d s u c h f u r t h e r proceedings a n d in s u c h m a n n e r shall he h a d t h e r e i n for t h e d e t e r m i n a t i o n thereof as m i g h t h a v e been h a d if t h e person s u i n g s u c h w r i t h a d b r o u g h t his action on t h e case for a false r e t u r n . 10. If a n y issue is joined on such proceedings, t h e person s u i n g such w r i t m a y t r y t h e s a m e in s u c h place as a n issue joined in s u c h action on t h e case m i g h t h a v e b e e n tried. 11. (1) If a verdict is found for t h e person s u i n g s u c h writ, or j u d g m e n t given for h i m u p o n a d e m u r r e r , or by nil dicit, or for w a n t of a replication or o t h e r p l e a d i n g -- (a) h e shall recover his d a m a g e s and costs in s u c h m a n n e r as h e m i g h t h a v e done in s u c h action on t h e c a s e ; a n d (b) a p e r e m p t o r y writ of m a n d a m u s shall be g r a n t e d w i t h o u t delay for h i m as m i g h t h a v e been if s u c h r e t u r n h a d been a d j u d g e d insufficient. (2) If j u d g m e n t is given for t h e person m a k i n g s u c h r e t u r n to t h e writ, he shall recover his costs of suit. 12. If a n y d a m a g e s are recovered by v i r t u e of this A c t against any s u c h person m a k i n g such r e t u r n , h e shall n o t be liable to be sued in a n y o t h e r a c t i o n or suit for t h e m a k i n g s u c h r e t u r n . 13. T h e Court m a y allow t h e person to w h o m a n y w r i t of m a n d a m u s is directed, or t h e person s u i n g or p r o s e c u t i n g t h e same, s u c h convenient t i m e to m a k e a r e t u r n , plead, reply, rejoin, or d e m u r , as to t h e Court seems j u s t a n d reasonable. 14. W h e r e a s writs of m a n d a m u s are sometimes issued to officers a n d other persons c o m m a n d i n g t h e m to a d m i t to offices or do or perform o t h e r m a t t e r s in respect whereof t h e y claim no r i g h t or i n t e r e s t or t h e i r functions arc m e r e l y ministerial, a n d it m a y be proper t h a t s u c h officers or persons should in c e r t a i n cases be p r o t e c t e d a g a i n s t t h e p a y m e n t of d a m a g e s or costs to w h i c h t h e y m a y otherwise become liable :-- (1) T h e Court u p o n a p p l i c a t i o n for a n y w r i t of m a n d a m u s m a y m a k e rules a n d orders calling, not only u p o n t h e person to w h o m s u c h writ m a y b e r e q u i r e d to issue, b u t also u p o n a n y o t h e r person h a v i n g or c l a i m i n g a n y r i g h t or interest in or to t h e m a t t e r of s u c h w r i t to show cause a g a i n s t t h e issue of s u c h writ a n d p a y m e n t of costs of t h e application. (2) U p o n t h e a p p e a r a n c e of s u c h other person, in c o m p l i a n c e w i t h a n y s u c h r u l e or order, or in default of a p p e a r a n c e after service thereof, t h e C o u r t m a y exercise all s u c h powers a n d a u t h o r i t i e s , and m a k e all s u c h r u l e s a n d orders applicable to t h e case as are given or m e n t i o n e d b y or in t h e I n t e r p l e a d e r Act, 1901 15. 15. T h e r e t u r n to a n y s u c h w r i t shall he m a d e , a n d t h e issues in Pact or i n law u p o n a n y t r a v e r s e thereof or d e m u r r e r shall be joined by a n d in t h e n a m e of t h e person to w h o m t h e w r i t is directed ; b u t the s a m e m a y , if t h e C o u r t so direct, h e expressed t o be m a d e a n d joined on the behalf of such other person as is m e n t i o n e d i n such r u l e or order. 16. I n t h a t case s u c h other person m a y frame t h e r e t u r n a n d c o n d u c t t h e s u b s e q u e n t proceedings a t his o w n expense, and if a n y j u d g m e n t is given for or a g a i n s t t h e p a r t y s u i n g such w r i t , s u c h j u d g m e n t shall be given a g a i n s t or for s u c h other person, w h o shall h a v e t h e like r e m e d y for t h e recovery of costs a n d enforcing t h e j u d g m e n t , as t h e person to w h o m t h e w r i t is directed would otherwise h a v e h a d . 17. If t h e r e t u r n to a n y s u c h writ is, in p u r s u a n c e of t h e a u t h o r i t y given b y this A c t , expressed to be m a d e on behalf of a n y o t h e r person as aforesaid, t h e f u r t h e r proceedings on s u c h w r i t shall n o t a b a t e or be discontinued by t h e d e a t h , or r e s i g n a t i o n , or r e m o v a l from office of t h e person h a v i n g m a d e s u c h r e t u r n ; b u t t h e s a m e shall be c o n t i n u e d a n d carried on in t h e n a m e of s u c h person, a n d if a p e r e m p t o r y w r i t is a w a r d e d , it m a y be directed to a n y successor in office or r i g h t to s u c h person. 18. I n all cases of application for a n y w r i t of m a n d a m u s w h a t soever, t h e costs of s u c h application, w h e t h e r t h e w r i t is g r a n t e d or refused, a n d also t h e costs of t h e w r i t , if t h e same is issued a n d obeyed, shall be in t h e discretion of t h e C o u r t ; a n d t h e C o u r t m a y order by w h o m a n d to w h o m t h e s a m e shall be paid.
