PUBLIC HEALTH (AMENDMENT) ACT. Act No. 12,1961. An Act to enable the Director-General of Public Health to nominate persons to act in his place on certain boards and committees; for this and other purposes to amend the Public Health Act, 1902, and certain other Acts; and for purposes connected therewith. [Assented to, 22nd March, 1961.] T > E it enacted by the Queen's Most Excellent Majesty, by ·*-* and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows: -- 1. (1) This Act may be cited as the "Public Health (Amendment) Act, 1961". (2) (2) This Act shall commence upon a day to be appointed by the Governor and notified by proclamation published in the Gazette. 2. (1) The Public Health Act, 1902, as amended by sub sequent Acts, is amended-- (a) by inserting in subsection one of section seven after the words "Director-General of Public Health" where firstly occurring the words ", or a person from time to time nominated by him,"; (b) by inserting in the same subsection after the words "that office" the words ", or a person from time to time nominated by him,". (2) The Public Health Act, 1902, as amended by sub sequent Acts and by this Act, may be cited as the Public Health Act, 1902-1961. 3. (1) The Pure Food Act, 1908, as amended by subse quent Acts, is amended by inserting at the end of subsection one of section six the following new paragraph : -- The president of the advisory committee may from time to time nominate a person to act in his place as a member, and as the president, of the advisory committee, and any such person so acting shall be deemed to be a member of the advisory committee and shall preside at meetings of the advisory committee at which he is present. (2) The Pure Food Act, 1908, as amended by subse quent Acts and by this Act, may be cited as the Pure Food Act, 1908-1961. 4. 4. (1) The Nurses Registration Act, 1953, as amended by subsequent Acts, is amended by inserting at the end of subsection one of section five the following new paragraph : -- The member referred to in paragraph (a) of this subsection may from time to time nominate a person to act in his place as a member, and as Chairman, of the Board, and any such person so acting shall be deemed to be a member of the Board and shall be Chairman of the Board at any meetings of the Board at which he is present. (2) The Nurses Registration Act, 1953, as amended by subsequent Acts and by this Act, may be cited as the Nurses Registration Act, 1953-1961. 5. (1) The Poisons Act, 1952, as amended by subsequent Acts, is amended-- (a) by omitting from subsection two of section five the words " ( a ) the persons for the time being holding the offices of Director-General of Public Health," and by inserting in lieu thereof the following new para graph and w o r d s : -- " ( a ) the person for the time being holding the office of Director-General of Public Health, or a person from time to time nominated by him; (ai) the persons for the time being holding the offices of"; (b) by omitting from subsection three of the same section the words "The Director-General of Public Health" and by inserting in lieu thereof the words "The member referred to in paragraph (a) of subsection two of this section". (2) The Poisons Act, 1952, as amended by subsequent Acts and by this Act, may be cited as the Poisons Act, 19521961. 6. 6. (1) The Medical Practitioners Act, 1938, as amended by subsequent Acts, is amended by inserting in subsection two of section thirty-four after the words "Director-General of Public Health" the words ", or a person from time to time nominated by him". (2) The Medical Practitioners Act, 1938, as amended by subsequent Acts and by this Act, may be cited as the Medical Practitioners Act, 1938-1961. 7. (1) The Mental Health Act, 1958, is amended-- (a) by inserting in subsection one of section seven after the word "appoint" the words "a Director-General of State Psychiatric Services,"; (b) by inserting at the end of the same subsection the following new paragraph : -- The Director of State Psychiatric Services and the Deputy Director of State Psychiatric Services shall, in the exercise or performance of their powers, authorities, duties and functions, be subject in all respects to the control and direction of the DirectorGeneral of State Psychiatric Services. (2) The Mental Health Act, 1958, as amended by this Act, may be cited as the Mental Health Act, 1958-1961. TRANSFERRED
