E it e n a c t e d b y t h e K i n g ' s M o s t E x c e l l e n t Majesty, b y a n d w i t h t h e advice a n d consent of t h e L e g i s l a t i v e C o u n c i l a n d L e g i s l a t i v e Assembly of N e w S o u t h W a l e s in P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of t h e same, as follows :-- 1. This A c t m a y be cited as t h e " P u b l i c Service ( S u p e r a n n u a  tion) Act, 1 9 0 8 . " 2. W h e r e -- (a) a n y person w h o h a s been employed as a n officer in t h e p u b l i c service is at t h e c o m m e n c e m e n t of this A c t in t h e r e c e i p t of a s u p e r a n n u a t i o n a l l o w a n c e u n d e r a n d b y v i r t u e of section t w o of t h e A c t N o . 55 of 1 8 9 9 ; a n d (b) i n p u r s u a n c e of t h e said section t h e s u p e r a n n u a t i o n allowance to w h i c h h e w o u l d h a v e b e e n e n t i t l e d if he h a d retired from t h e service u n d e r t h e provisions of section f o r t y - t h r e e of t h e Civil Service A c t of 1884 h a s b e e n diminished by a n a m o u n t certified b y t h e a c t u a r i e s a p p o i n t e d u n d e r t h a t A c t t o be e q u i v a l e n t t o t h e a n n u i t y t e r m i n a b l e on his d e a t h i n t o w h i c h t h e a m o u n t of a n y p a y m e n t s , g r a t u i t i e s , a n d r e f u n d s received b y h i m on his r e t i r e m e n t f r o m t h e service is c o n v e r t i b l e ; a n d (c) t h e s u m of t h e a m o u n t s b y w h i c h s u c h a l l o w a n c e h a s from t i m e to t i m e b e e n d i m i n i s h e d as aforesaid, h a s a t a n y t i m e before or after t h e c o m m e n c e m e n t of t h i s A c t e q u a l l e d t h e a m o u n t of t h e p a y m e n t s , g r a t u i t i e s , a n d refunds received as aforesaid, the s u p e r a n n u a t i o n allowance p a y a b l e to t h e said person shall t h e r e  upon be d e e m e d to h a v e ceased to he d i m i n i s h e d as aforesaid.
