(Q02/00123/S69) DIANE BEAMER, M.P., Minister Assisting the Minister for Infrastructure and Planning (Planning Administration) Published in Gazette No 114 of 18 July 2003, page 7407 Page 1 2003 No 493 Clause 1 Wingecarribee Local Environmental Plan 1989 (Amendment No 113) Wingecarribee Local Environmental Plan 1989 (Amendment No 113) under the Environmental Planning and Assessment Act 1979 1 Name of plan This plan is Wingecarribee Local Environmental Plan 1989 (Amendment No 113). 2 Aims of plan This plan aims to allow, with the consent of Wingecarribee Shire Council, the carrying out of development for the purpose of infrastructure on the land to which this plan applies. 3 Land to which plan applies This plan applies to all land to which Wingecarribee Local Environmental Plan 1989 applies, except for land within Zone No 8 (a) (the Existing National Parks and Nature Reserves Zone) under the 1989 plan. 4 Amendment of Wingecarribee Local Environmental Plan 1989 Wingecarribee Local Environmental Plan 1989 is amended as set out in Schedule 1. Page 2 2003 No 493 Wingecarribee Local Environmental Plan 1989 (Amendment No 113) Amendment Schedule 1 Schedule 1 Amendment (Clause 4) Clause 36A Insert after clause 36: 36A Infrastructure development (1) (2) This clause applies to all land under this plan, except for land within Zone No 8 (a). Despite any other provision of this plan, the council may consent to the carrying out of development on the land to which this clause applies for the purpose of infrastructure, whether for private or public use. In this clause: infrastructure means the means through which the following services are provided: transport (including, but not limited to, road, rail, aviation or aerial, pedestrian, equine and cycle); bushfire hazard reduction; telecommunications; supply of water, hydraulic power, electricity or gas; sewerage or drainage; flood mitigation works.
