Dated at Sydney, this 28th September 1994. W. S. MACHIN, M.P., Minister for Consumer Affairs. Citation 1. This Order may be cited as Business Licences (Fees) Order 1994, No. 3. Commencement 2. This Order has effect OR and from 1 October 1994. Licences to Which Order Applies 3. This Order applies to licences which are authorities under Regulations made under the Traffic Act 1909, to use premises for the purposes of conducting inspections of motor vehicles to determine whether they are suitable for safe use or comply with the requirements of that Act or Regulations. * The Order appointed 1.10.94 as the date of commencement. By s. 18 (3) of the Business Licences Act 1990. the Interpretation Act 1987 applies to an order under s. 18 as if the order were a statutory rule. Pursuant to s. 39 (1) (a) of the Interpretation Act 1987, a statutory rule takes effect on the day on which it is published in the Gazette (or. if a later day is specified in the rule for that purpose, on the later day so specified). 2 1994--No. 538 Fees to Which Order Applies 4. The fees to which this Order applies are set forth hereunder. For an application for the grant of a licence $200 Time Fee Payable 5. Any such fee is payable with the application. Refund or Waiver of Fee 6. The licensing authority may, in respect of the whole or part of any such fee authorise a refund where the application is withdrawn or refused or may authorise a waiver where the authority determines to exempt the applicant from payment. Repeal 7. Business Licences (Fees) Order 1994, No. 2, published in the Government Gazette No. 83, of 24th June 1994, is repealed.
