New South Wales Commencement Proclamation under the Local Government Amendment (Governance and Planning) Act 2016 No 38 DAVID HURLEY, Governor I, General The Honourable David Hurley AC DSC (Ret'd), Governor of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 (1) of the Local Government Amendment (Governance and Planning) Act 2016, do, by this my Proclamation, appoint 25 November 2016 as the day on which Schedule 1 [42]­[45] to that Act commence. Explanatory note The object of this Proclamation is to commence certain amendments made by the Local Government Amendment (Governance and Planning) Act 2016 to the Local Government Act 1993 that: (a) require the Minister for Local Government to give notice to a council of the Minister's intention to appoint a financial controller, when giving notice of a proposed performance improvement order (improvement order) for the council, and (b) enable the Minister to appoint a financial controller to a council if the Minister issues an improvement order for the council, and (c) enable regulations to be made to establish criteria that must be considered by the Minister in deciding whether to appoint a financial controller to a council, and (d) provide for the operations of a financial controller once appointed, and (e) enable regulations to be made to establish criteria that must be considered by the Minister in deciding whether to appoint a temporary adviser to a council.
