2000 No 626 New South Wales Fisheries Management (General) Amendment (Bag Limits) Regulation 2000 under the Fisheries Management Act 1994 His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Fisheries Management Act 1994. The Hon EDWARD OBEID, M.L.C., Minister for Fisheries Explanatory note The Fisheries Management (General) Regulation 1995 sets out the maximum number of fish of any particular species that a recreational fisher may take in any one day, or may be in possession of at any time (known as "bag limits"). It also sets out minimum and maximum size requirements for a number of species of fish. The objects of this Regulation are as follows: (a) to introduce or change bag limits for certain fish, including gemfish, billfishes, various species of perch, wahoo, mangrove jacks, sharks and rays, prawns, tuna and dusky flathead, (b) to introduce a general bag limit of 20 for most marine species of fish that are not currently the subject of a bag limit, (c) to increase the minimum size for dusky (or common) flathead and snapper. This Regulation has a staggered commencement. Most of the changes will commence on 1 November 2000, but the changes relating to dusky flathead and snapper will not commence until 1 July 2001. Page 2 2000 No 626 Fisheries Management (General) Amendment (Bag Limits) Regulation 2000 Clause 1 Fisheries Management (General) Amendment (Bag Limits) Regulation 2000 1 Name of Regulation This Regulation is the Fisheries Management (General) Amendment (Bag Limits) Regulation 2000. 2 Commencement (1) This Regulation commences on 1 November 2000, except as provided by subclause (2). (2) Schedule 1 [1], [2] and [6] commence on 1 July 2001. 3 Amendment of Fisheries Management (General) Regulation 1995 The Fisheries Management (General) Regulation 1995 is amended as set out in Schedule 1. 4 Notes The explanatory note does not form part of this Regulation. [3] Clause 10A Insert after clause 10: 10A General bag limit (1) For any species of marine or estuarine fish (including marine or estuarine invertebrates and tunicates) not included in the Table to this Division: (a) the daily limit of fish of that species is 20, and (b) the possession limit of fish of that species (when the person in possession is in or on or adjacent to any waters or is transporting or storing the fish) is 20. Note. Examples of the species of fish to which this clause applies are squid, cuttlefish and octopus. (2) Subclause (1) does not apply to the following species of fish: (a) all species of family Clupeidae (such as pilchards, whitebait, blue bait and herring), (b) all species of family Engraulididae (such as anchovies), (c) all Trachurus spp (such as yellowtail and jack mackerel), (d) slimy mackerel (Scomber australasicus).
