HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Public Health Act 1902, has been pleased to make the Regulation set forth hereunder. (C. 3064/19)

PETER COLLINS Minister for Health. The Public Health (Funeral Industries) Regulation 1987 is amended by inserting after clause 33 (6) the following subclause: (7) The Secretary may grant an approval under subclause (6) even though: (a) the deceased person is known or reasonably suspected to have been suffering from an infectious or proclaimed disease at the time of death; or (b) 7 years or less has elapsed since the date of the original burial, if the Secretary is satisfied that adequate precautions will be taken to ensure that the exhumation does not pose a threat to public health.
EXPLANATORY NOTE

The object of this Regulation is to amend the Public Health (Funeral Industries) Regulation 1987 to enable the Secretary of the Department of Health to approve the exhumation of the remains of a deceased person for the purpose of reburial, cremation or transfer of the body overseas if the Secretary is satisfied that adequate
