1994--No. 555 TRAFFIC ACT 1909--REGULATION (Relating to fire engines and other vehicles proceeding to an emergency) NEW SOUTH WALES [Published in Gazette No. 143 of 21 October 1994] HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder. Bruce Baird, MP Minister for Transport and Minister for Roads. Commencement 1. This Regulation commences on 1 November 1994. Amendment of the Motor Traffic Regulations 1935 2. The Motor Traffic Regulations 1935 are amended: (a) by inserting in Regulation 79 (2) (c) after the words "a fire" the words "or other emergency"; (b) by inserting in Regulation 80 (2) (b) after the words "a fire'' the words "or other emergency". Amendment of the General Traffic Regulations 1916 3. The General Traffic Regulations 1916 are amended by inserting in Section 14 (3) after the words "a fire" the words "or other emergency". EXPLANATORY NOTE The object of this Regulation is to extend to fire engines, reels and other vehicles proceeding to an emergency which is not a fire the Same protections as are currently afforded under the Motor Traffic Regulations 1935 and the General Traffic Regulations 1916 to such vehicles when they are proceeding to a fire. The following provisions are 2 1994--No. 555 extended so that they apply in respect of vehicles proceeding to any emergency (whether or not the emergency is a fire): (a) the provision allowing a fire engine or other fire-fighting appliance proceeding to a fire to take precedence over other vehicles in boarding a ferry or punt (Regulation 79 of the Motor Traffic Regulations); (b) the provision requiring motorists on public streets to give way to fire engines, reels and other vehicles apparently proceeding to a fire (Regulation 80 of the Motor Traffic Regulations); (c) the provision exempting fire engines, reels and similar vehicles, and their drivers, from the requirements of the General Traffic Regulations when they are proceeding to a fire (Section 14 of those Regulations). This Regulation is made under the Traffic Act 1909, including section 3 (the general regulation making power).
