1991--No. 624 TRAFFIC ACT 1909--REGULATION (Relating to the wearing of seat belts and child restraints) NEW SOUTH WALES [Published in Gazette No. 169 of 6 December 1991] HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Traffic Act 1909, has been pleased to make the Regulation set forth hereunder. WAL MURRAY Minister for Roads. Commencement 1. This Regulation commences on 14 December 1991. Amendments 2. The Motor Traffic Regulations 1935 are mended: (a) by omitting Regulation 110F (3) (b); and (b) by omitting Regulation 110G (3) (b). EXPLANATORY NOTE The purpose of this Regulation is to remove certain exemptions from the Motor Traffic Regulations 1935 relating to the wearing of seat belts and child restraints in motor vehicles with front and rear seat positions. At present, those exemptions: (a) allow a passenger to occupy a rear seat position not fitted with a seat belt even if there is another available seat position in the vehicle that is so fitted; and 2 1991--No. 624 (b) allow a person to drive a motor vehicle with a child travelling in a front seat position not fitted with a suitable child restraint if there is no unoccupied rear seat position. The effect of this Regulation is: (a) to require a passenger in a motor vehicle to occupy an available seat position to which a seat belt has been fitted; and (b) to prohibit a person from driving a motor vehicle while a child travelling in a front seat position is not properly restrained by a suitable child restraint, even if there is no unoccupied rear seat position.
