2000 No 168 New South Wales Road Transport (Safety and Traffic Management) (Road Rules) Amendment (Testing of Speed Measuring Devices) Regulation 2000 under the Road Transport (Safety and Traffic Management) Act 1999 His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (Safety and Traffic Management) Act 1999. CARL SCULLY, M.P., Minister for Roads Explanatory note The object of this Regulation is to empower the Roads and Traffic Authority to approve the manufacturer's recommended calibration method for the testing for accuracy and functional requirements of certain non-radar-based speed measuring devices used by that Authority. At present, the Commissioner of Police has sole power to approve the recommended method. Certificate evidence of such an approval may be given, for the purpose of establishing the accuracy or reliability of an approved speed measuring device, in any court proceedings in which evidence is given of a measurement of speed obtained by use of such a device. This Regulation is made under the Road Transport (Safety and Traffic Management) Act 1999 and, in particular, under section 46 (Certificates concerning use of approved speed measuring devices) and section 71 and Schedule 1 (the general regulation-making power).
