I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of Schedule 1 to the Statute Law (Miscellaneous Provisions) Act (No. 2) 1994, do, by this my Proclamation, appoint 19 April 1995 as the day on which the amendment to the Strata Titles (Leasehold) Act 1986 set out in that Schedule commences. EXPLANATORY NOTE Clause 2 (2) of Schedule 2A to the Strata Titles (Leasehold) Act 1986 specifies certain persons who must be members of the building management committee of a building that is subject to one or more leasehold strata schemes. At present, those persons include the body corporate for each leasehold strata scheme for part of the building, and any other person in whom is vested an estate in fee simple in any part of the building or its site that is not subject to a leasehold strata scheme. They do not include any lessees of a part of the building or site that is not subject to a leasehold strata scheme. The amendment commenced by this Proclamation removes that anomaly by including on the committee the head lessees (but not sublessees) of those parts of the building or site that are not subject to a leasehold strata scheme.
