I, Rear Admiral PETER ROSS SINCLAIR, A.C., Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of Schedule 1 to the Statute Law (Miscellaneous Provisions) Act (No. 3) 1992, do, by this my Proclamation, appoint 28 May 1993 as the day on which the amendment to the Food Act 1989 set out in that Schedule commences. EXPLANATORY NOTE The object of this Proclamation is to commence the amendment to the Food Act 1989 contained in the Statute Law (Miscellaneous Provisions) Act (No. 3) 1992. That amendment changes the time limit for the delivery of copies of a warranty as to food by a defendant in a prosecution for an offence related to selling food if the defendant wishes to rely on the warranty as a defence. The copies will, in future, need to be delivered to the prosecution and to the provider of the warranty not later than 7 days before the hearing date. This is instead of the present requirement that they be delivered within 10 days after service of the summons for the offence.
