New South Wales Workers Compensation Amendment (Death Benefits) Regulation 2015 under the Workers Compensation Act 1987 His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Workers Compensation Act 1987. VICTOR DOMINELLO, MP Minister for Innovation and Better Regulation Explanatory note The object of this Regulation is to provide for an increase in the amount of lump sum compensation payable in respect of the death of certain volunteer fire, emergency and rescue services workers for the purposes of the Workers Compensation (Bush Fire, Emergency and Rescue Services) Act 1987. The Regulation will have the effect of increasing that amount from $524,000 to $750,000 in respect of deaths occurring on or after 5 August 2015. This Regulation is made under the Workers Compensation Act 1987, including section 280 (the general regulation-making power) and Parts 19I and 20 of Schedule 6. Published LW 18 December 2015 (2015 No 821) Workers Compensation Amendment (Death Benefits) Regulation 2015 [NSW] Workers Compensation Amendment (Death Benefits) Regulation 2015 under the Workers Compensation Act 1987 1 Name of Regulation This Regulation is the Workers Compensation Amendment (Death Benefits) Regulation 2015. 2 Commencement This Regulation is taken to have commenced on 21 August 2015 and is required to be published on the NSW legislation website. 3 Amendment of Workers Compensation Regulation 2010 Schedule 8 Savings and transitional provisions Insert at the end of the Schedule, with appropriate Part and clause numbering: Part Special provision for death benefits--2015 amendments Application of death benefits amendment to fire, emergency and rescue services volunteers (1) To the extent that clause 3 of Part 19I of Schedule 6 to the 1987 Act applies in respect of the Workers Compensation (Bush Fire, Emergency and Rescue Services) Act 1987, that clause does not apply to the amendment made by the 2015 amending Act to section 25 of the 1987 Act (or to clause 5 of that Part in its application to that amendment). Note. The effect of this subclause is that a reference in the Workers Compensation (Bush Fire, Emergency and Rescue Services) Act 1987 to section 25 of the 1987 Act is (in respect of deaths occurring on or after 5 August 2015) a reference to that provision as amended by the 2015 amending Act. (2) (3) The provisions of Part 19I of Schedule 6 to the 1987 Act are deemed to be amended to the extent necessary to give effect to this clause.
