HEALTH CARE DECISION MAKING ACT 2023 (NO 19 OF 2023) - SECT 85

Section 23

repeal , insert

23     Health care decisions

    (1)     A guardian has authority to make health care decisions for the represented adult if the guardian has authority under the guardianship order for the health care decision.

    (2)     The authority of a guardian regarding a health care decision is subject to:

    (a)     the Advance Personal Planning Act 2013 ; and

    (b)     the Health Care Decision Making Act 2023 .
