MINERAL TITLES ACT 2010 (NO 27 OF 2010) - SECT 150

A person commits an offence if the person:

    (a)     enters into an agreement relating to the payment of compensation under section 107 or 2011_Actm051.html#_Ref244688700">108 ; and

    (b)     the agreement is contrary to a provision of Part 5, Division 6 relating to an entitlement to, or the payment of, compensation.

Fault elements:

The person:

    (a)     intentionally enters into the agreement; and

    (b)     is reckless about whether the agreement is contrary to a provision of Part 5, Division 6 relating to an entitlement to, or the payment of, compensation.

Maximum penalty:     400 penalty units or imprisonment for 2 years.
