RAIL SAFETY (NATIONAL UNIFORM LEGISLATION) ACT 2012 (NO 27 OF 2012) - SECT 32

    (1)     This section applies if a rail safety worker:

    (a)     is required by an authorised person to submit to a preliminary breath test or breath analysis and the worker:

        (i)     refuses or fails to comply with the requirement; and

        (ii)     does not provide a sample of his or her blood as mentioned in section  20 (2); or

    (b)     is required by an authorised person to submit to a drug screening test, oral fluid analysis or to provide a sample of his or her blood and the worker refuses or fails to comply with the requirement.

    (2)     The authorised person must, as soon as practicable, report the refusal or failure to comply with the requirement to:

    (a)     the accredited person for whom the rail safety worker performs rail safety work; and

    (b)     the Regulator.
