SERIOUS SEX OFFENDERS ACT 2013 (NO 9 OF 2013) - SECT 21

Considerations when giving directions

    (1)     In deciding whether to give a direction to a supervisee, a parole officer must have regard to the following:

    (a)     as the paramount consideration – the need to protect:

        (i)     victims of serious sex offences committed, or likely to be committed, by the supervisee; and

        (ii)     the victims' families; and

        (iii)     members of the community generally;

    (b)     as a secondary consideration – the desirability of providing rehabilitation, care and treatment for the supervisee.

    (2)     In considering the need for protection mentioned in subsection (1)(a), the parole officer must have regard to the following:

    (a)     the need to ensure that the supervisee is managed and supervised in the way determined by the Director of Correctional Services under section 63 ;

    (b)     the need to ensure that the supervisee's compliance with his or her supervision order is monitored and enforced.
