2002 A BILL FOR An Act to amend the Agricultural Colleges Act 1994

 


 

s1 6 s4 Agricultural Colleges Amendment Bill 2002 The Parliament of Queensland enacts-- 1 1 Short title Clause 2 This Act may be cited as the Agricultural Colleges Amendment Act 2002. 3 2 Act amended Clause 4 This Act amends the Agricultural Colleges Act 1994. 5 3 Amendment of s 3 (Definitions) Clause 6 (1) Section 3-- 7 insert-- 8 ` "pastoral care" includes-- 9 (a) care and support provided for students in a safe living and 10 working environment; and 11 (b) care and support provided-- 12 (i) with the help of people in the college or the community the 13 director considers have appropriate life experience or skills, 14 or the ability, to work with young people who may be 15 experiencing personal or educational difficulties; and 16 (ii) to help students develop interpersonal and living skills.'. 17 (2) Section 3, definition "State land", paragraph (a)-- 18 omit, insert-- 19 `(a) granted in trust, or reserved for a community purpose, under the 20 Land Act 1994; and'. 21 4 Replacement of s 4 (Declaration of agricultural colleges) Clause 22 Section 4-- 23 omit, insert-- 24

 


 

s5 7 s6 Agricultural Colleges Amendment Bill 2002 `4 Declaration of agricultural college 1 `(1) This section applies to a registered training organisation operated by 2 the State that offers, or will offer, courses of the following kinds-- 3 (a) courses about agriculture; 4 (b) courses of particular benefit to-- 5 (i) persons engaged in rural industry or related industries; or 6 (ii) persons in the community in the area served, or to be served, 7 by the organisation. 8 `(2) The Minister may, by gazette notice, declare the registered training 9 organisation to be an agricultural college. 10 `(3) The Minister may, in the gazette notice, specify a name for the 11 college using any 1 or more of the following as the basis for the name-- 12 (a) a description of the locality the college serves; 13 (b) the main training function of the college; 14 (c) the main business function of the community the college serves.'. 15 5 Amendment of s 6 (Board of trustees) Clause 16 Section 6(3) and (4)-- 17 omit, insert-- 18 `(3) The corporation's name is the [Name of agricultural college] 19 Board.'. 20 6 Amendment of s 7 (Functions of college board) Clause 21 Section 7(3)-- 22 omit, insert-- 23 `(3) Without limiting subsection (2), the college board's functions 24 include the following-- 25 (a) establishing and reviewing the college's strategic direction; 26 (b) developing and implementing strategic plans and business plans 27 for the college; 28 (c) deciding policy for achieving the college's main business 29 purpose, and for other college purposes; 30

 


 

s7 8 s7 Agricultural Colleges Amendment Bill 2002 (d) ensuring the college develops and implements appropriate risk 1 management strategies; 2 (e) ensuring the college board complies with applicable financial 3 accountability requirements; 4 (f) ensuring the college complies with national and State quality 5 standards and audit requirements for registered training 6 organisations; 7 (g) ensuring the college provides access to training for Aboriginal 8 people, Torres Strait Islanders and others with particular needs at 9 a level that reflects the composition of the community the college 10 serves; 11 (h) ensuring appropriate pastoral care is available for students; 12 (i) developing and implementing appropriate strategies to help 13 students make the transition from an educational environment to 14 the workplace; 15 (j) maintaining the industry links necessary for achieving support 16 from industry for the college's activities; 17 (k) encouraging opportunities for growth in the college's training 18 market, including opportunities outside Australia; 19 (l) monitoring the performance of the director and the college.'. 20 7 Amendment of s 8 (Powers of college board) Clause 21 (1) Section 8(1)(e) and (f)-- 22 renumber as section 8(1)(g) and (h). 23 (2) Section 8(1)-- 24 insert-- 25 `(e) provide residential accommodation for purposes associated with 26 the college; and 27 (f) appoint the college's director under section 26; and'. 28 (3) Section 8(2)-- 29 omit. 30 (4) Section 8(3)(a), `(other than in a minor way)'-- 31 omit. 32

 


 

s8 9 s9 Agricultural Colleges Amendment Bill 2002 (5) Section 8(3)(d), `sell'-- 1 omit, insert-- 2 `buy land for the college or sell or lease'. 3 (6) Section 8(3), as amended-- 4 renumber as section 8(2). 5 (7) Section 8-- 6 insert-- 7 `(3) Subsection (2)(a), (b) and (c) does not apply to the alteration or 8 extension of a college building, or a building to be built or bought for the 9 college, if the actual or estimated cost of altering, extending, building or 10 buying the building is not more than an amount fixed for this section by the 11 Minister by gazette notice.'. 12 8 Amendment of s 10 (College board is subject to direction) Clause 13 Section 10-- 14 insert-- 15 `(2) If the Minister gives a college board a direction under 16 subsection (1), the board must include in its annual report particulars of the 17 direction and what the board did in response to the direction.1'. 18 9 Insertion of new s 10A Clause 19 After section 10-- 20 insert-- 21 `10A Reporting and accountability 22 `(1) The Minister may, in writing, require a college board to give the 23 Minister stated information and reports in the way and within the time the 24 Minister requires. 25 `(2) The college board must comply with a requirement given under 26 subsection (1) to the extent the college board is able to comply with it. 27 1 For the requirement for the annual report, see the Financial Administration and Audit Act 1977, section 46J (Annual report).

 


 

s 10 10 s 10 Agricultural Colleges Amendment Bill 2002 `(3) However, if the board can not comply with the requirement, the 1 board must give the Minister reasons for not being able to comply with it. 2 `(4) Also, a college board must give the Minister a report on any matter 3 of which the board becomes aware that may significantly affect the ability 4 of the board to achieve the objectives stated in the strategic plan for the 5 college or another document given to or made with the chief executive and 6 relevant to the operation of the college. 7 `(5) The college board must give the Minister a report mentioned in 8 subsection (4) as soon as practicable, but within 1 month, after the board 9 first becomes aware of the matter.'. 10 10 Replacement of s 13 (Official members) Clause 11 Section 13-- 12 omit, insert-- 13 `13 Official members 14 `(1) There are 5 official members. 15 `(2) The official members are-- 16 (a) the college's director; and 17 (b) a nominee of the chief executive; and 18 (c) a nominee of the chief executive of the department that deals 19 with matters under the Stock Act 1915; and 20 (d) a staff member of the college nominated by college staff; and 21 (e) a nominee of the college's student advisory council. 22 `(3) The person mentioned in subsection (2)(e)-- 23 (a) must be a member of the student advisory council mentioned in 24 section 27A(2)(a) or (b); and 25 (b) stops being an official member when the person's term as a 26 member of the student advisory council ends.2 27 `(4) The entity responsible for nominating a person as an official 28 member under subsection (2)(b), (c) or (d)-- 29 2 See section 27D (Term of membership)

 


 

s 11 11 s 11 Agricultural Colleges Amendment Bill 2002 (a) may, in the nomination, specify a term, of not more than 3 years, 1 for which the person is the entity's nominee; and 2 (b) may withdraw the person's nomination as an official member by 3 signed notice given to the chairperson and the person. 4 `(5) A person mentioned in subsection (2)(b), (c) or (d) stops being an 5 official member on the withdrawal of the person's nomination under 6 subsection (4)(b).'. 7 11 Amendment of s 14 (Appointed members) Clause 8 (1) Section 14(1), `9'-- 9 omit, insert-- 10 `7'. 11 (2) Section 14(3), `The appointed members are'-- 12 omit, insert-- 13 `The appointed members must consist of'. 14 (3) Section 14(3)(c) and (d)-- 15 omit. 16 (4) Section 14(3)(e)-- 17 renumber as section 14(3)(c). 18 (5) Section 14(4) and (5)-- 19 omit, insert-- 20 `(4) Each member mentioned in subsection (3)(a), must be a nominee of 21 an entity engaged in rural industry in the area served by the college. 22 `(5) Each member mentioned in subsection (3)(c), must-- 23 (a) have experience in an industry whose needs are serviced by 24 training provided by the college; or 25 (b) be a member of the community served by the college. 26 `(6) Also, the members mentioned in subsection (3)(a) and (c) must be 27 persons the Minister considers have the skills and experience the Minister 28 considers necessary to enable them to contribute effectively to the college 29 board's ability to perform its functions. 30 31 Examples of skills for subsection (6)--

s 16 13 s 16 Agricultural Colleges Amendment Bill 2002 16 Insertion of new ss 22A-22B Clause 1 After section 22-- 2 insert-- 3 `22A Voting 4 `At a meeting of the college board-- 5 (a) a question is to be decided by a majority of the votes of the 6 members present and voting; and 7 (b) each member present has a vote on each question to be decided 8 and, if the votes are equal, the chairperson also has a casting 9 vote. 10 `22B Conflict of interest 11 `(1) A member of a college board who has a material personal interest in 12 an issue being considered by the board must not-- 13 (a) vote on the issue; or 14 (b) vote on a proposed resolution (a "related resolution") under 15 subsection (2) about the issue, whether in relation to the member 16 or another member; or 17 (c) be present while the issue, or a related resolution, is being 18 considered by the college board; or 19 (d) otherwise take part in any decision of the college board about the 20 issue or a related resolution. 21 Maximum penalty--100 penalty units. 22 `(2) Subsection (1) does not apply to the issue if the college board has at 23 any time passed a resolution that-- 24 (a) specifies the member, the interest and the issue; and 25 (b) states that the members voting for the resolution are satisfied the 26 interest should not disqualify the member from considering or 27 voting on the issue. 28 `(3) A quorum is present during a consideration of an issue by the 29 college board only if the members present who are entitled to vote on any 30 motion that may be moved about the issue number at least 1 less than half 31 the number of members required to form a quorum under section 22.'. 32

 


 

s 17 14 s 18 Agricultural Colleges Amendment Bill 2002 17 Amendment of s 23 (Conduct of meeting) Clause 1 Section 23-- 2 insert-- 3 `(2) The board may hold meetings, or allow members to take part in its 4 meetings, by using any technology that reasonably allows members to hear 5 and take part in discussions as they happen 6 7 Example of use of technology-- 8 Teleconferencing.'. 18 Insertion of new pt 2A Clause 9 After section 25-- 10 insert-- 11 `PART 2A--ADMINISTRATOR 12 `25A Appointment of administrator 13 `(1) This section applies if the Minister-- 14 (a) is satisfied a college board has, for any reason, stopped 15 functioning effectively; or 16 (b) considers a college board is acting in a way that is prejudicial to 17 the interests of its college. 18 `(2) The Minister may, by gazette notice, appoint as administrator of the 19 relevant agricultural college a person the Minister considers has 20 appropriate qualifications and experience to be the administrator. 21 `(3) The administrator is to be appointed for the term, and on the 22 conditions decided by the Minister. 23 `(4) However, the Minister may, by gazette notice, fix an earlier day as 24 the day the purpose of the administration ends. 25 `(5) The administrator-- 26 (a) holds office subject to the direction of the Minister; and 27 (b) stops holding office-- 28

 


 

s 18 15 s 18 Agricultural Colleges Amendment Bill 2002 (i) when the term of the appointment ends unless the 1 administrator stops holding office under section 18(1)(a) 2 or (d)4; or 3 (ii) at the end of the day fixed under subsection (4). 4 `25B College board members go out of office 5 `(1) On the appointment of an administrator of a college, the members of 6 the college board go out of office. 7 `(2) No compensation is payable to a member of the college board 8 because of subsection (1). 9 `25C Administrator is college board 10 `(1) For all purposes of this Act, the administrator of a college is the 11 college board. 12 `(2) Subject to subsection (3), part 2, divisions 2 to 55 do not apply to the 13 administrator. 14 `(3) Section 18(1)(a) and (d) and 246 apply to the administrator as if the 15 administrator were a member of the college board. 16 `25D Additional functions of the administrator 17 `(1) The administrator of a college has the following additional 18 functions-- 19 (a) to do anything necessary or convenient for the benefit of the 20 college until the purpose of the administration is achieved and 21 appropriate arrangements can be made for the appointment of a 22 new college board; 23 (b) to give the Minister a report on the college board's financial 24 position and anything else the Minister requires the administrator 25 to include in the report; 26 4 Section 18 (Vacation of office) 5 Part 2 (Agricultural College Boards), divisions 2 (College board composition and members), 3 (Chairperson and deputy chairperson), 4 (Meetings of college board) and 5 (Other provisions about college board members) 6 Sections 18 (Vacation of office) and 24 (Entitlements of college board members)

 


 

s 19 16 s 20 Agricultural Colleges Amendment Bill 2002 (c) to give the Minister a final report on the administrator's 1 administration, including details of any directions given by the 2 Minister to the administrator. 3 `(2) The Minister must table the administrator's final report in the 4 Legislative Assembly within 28 days after receiving it. 5 `25E Completion of administration 6 `On the completion of the administration, the administrator of a college 7 is, in the absence of fraud or dishonesty, released from responsibility to 8 account for the administration of the college.'. 9 19 Amendment of s 26 (Director) Clause 10 Section 26(2) to (4)-- 11 omit, insert-- 12 `(2) The college board is to appoint the director. 13 `(3) The director is the chief executive officer of the college. 14 `(4) Subject to the board, the director-- 15 (a) is responsible for the day to day management of the college; and 16 (b) may appoint the college's staff. 17 `(5) The director and the college staff are appointed under this Act and 18 not under the Public Service Act 1996.'. 19 20 Insertion of new pt 3A Clause 20 After section 27-- 21 insert-- 22 `PART 3A--STUDENT ADVISORY COUNCIL 23 `27A Student advisory council 24 `(1) There is a student advisory council. 25 `(2) The student advisory council consists of not more than 8 members 26 comprising not more than-- 27

 


 

s 20 17 s 20 Agricultural Colleges Amendment Bill 2002 (a) 5 students; and 1 (b) 1 former student; and 2 (c) 2 staff members. 3 `27B Eligibility 4 `(1) The following persons are eligible to be a member of the student 5 advisory council-- 6 (a) students of the college; 7 (b) former students of the college who graduated from the college 8 within the 5 years before the start of the year for which the 9 person is to be a member of the advisory council; 10 (c) staff members of the college. 11 `(2) The following persons are not eligible to be a member of the student 12 advisory council-- 13 (a) an official member of the college board, other than the nominee 14 of the student advisory council; 15 (b) an appointed member of the college board. 16 `(3) The students of the college are to elect persons from the persons 17 mentioned in subsection (1)(a) as members of the student advisory council. 18 `(4) The college staff are to elect persons from the persons mentioned in 19 subsection (1)(c) as members of the student advisory council. 20 `(5) An entity entitled to elect persons as members of the student 21 advisory council must elect the persons as and when required by the 22 college board. 23 `(6) The college board is to decide the way the member mentioned in 24 section 27A(2)(b) is to be selected. 25 `27C Functions 26 `(1) The student advisory council has the following functions-- 27 (a) advising the college board or the director on matters the board or 28 director refers to the advisory council; 29

 


 

s 21 18 s 22 Agricultural Colleges Amendment Bill 2002 (b) advising the college board or the director on matters about the 1 college or students the advisory council considers should be 2 referred to the board or director; 3 (c) other functions conferred on it by this Act. 4 `(2) The student advisory council is not the employee or agent of the 5 college board. 6 `27D Term of membership 7 `(1) A member of a college's student advisory council for a particular 8 year holds office until the end of that calendar year and may resign the 9 office by signed notice given to the director. 10 `(2) However, a student advisory council member who is a student or a 11 staff member stops being a member of the advisory council on stopping 12 being a student or staff member. 13 `27E Conduct of meetings 14 `(1) The advisory council must choose a student member to be the 15 chairperson of the advisory council. 16 `(2) The advisory council may otherwise regulate its proceedings as it 17 considers appropriate.'. 18 21 Amendment of s 28 (Application of Land Act 1962) Clause 19 (1) Section 28, heading, `Land Act 1962'-- 20 omit, insert-- 21 `Land Act 1994'. 22 (2) Section 28(1), `Land Act 1962'-- 23 omit, insert-- 24 `Land Act 1994'. 25 22 Amendment of s 32 (General fund) Clause 26 Section 32(3), from `fund'-- 27 omit, insert-- 28

s 30 21 s 30 Agricultural Colleges Amendment Bill 2002 30 Insertion of new pt 7, div 2 Clause 1 After section 48-- 2 insert-- 3 `Division 2--Transitional provisions for Agricultural Colleges 4 Amendment Act 2002 5 `49 Existing agricultural colleges 6 `Each agricultural college in existence immediately before the 7 commencement of the Agricultural Colleges Amendment Act 2002, 8 section 4 continues to be an agricultural college as if it had been declared to 9 be an agricultural college under this Act as in force on the commencement 10 of that section. 11 `50 Official members 12 `(1) On the commencement of the Agricultural Colleges Amendment Act 13 2002, section 10, the person who was an official member of a college board 14 because of section 13(2)(b) of this Act as in force immediately before the 15 commencement continues to be an official member of the college board of 16 which the person was an official member. 17 `(2) On the commencement of the Agricultural Colleges Amendment Act 18 2002, section 10, the person who was an official member of a college board 19 because of section 13(2)(c) of this Act as in force immediately before the 20 commencement continues to be an official member of the college board 21 until the person stops being the president of the student body recognised by 22 the director as representing the interests of the college's students. 23 `51 Appointed member who becomes official member 24 `(1) On the commencement of the Agricultural Colleges Amendment Act 25 2002, section 10, a person who was an appointed member of a college 26 board because of section 14(3)(c) or (d) of this Act as in force immediately 27 before the commencement becomes an official member of the college 28 board to which the person was appointed. 29 `(2) The member continues to be an official member until the member 30 stops being the nominee of the relevant entity for any reason, including the 31 appointment of someone else as the entity's nominee. 32
