1996 A BILL FOR An Act to amend the Ambulance Service Act 1991
s1 6 s4 Ambulance Service Amendment The Parliament of Queensland enacts-- 1 title 2 Short Clause 1. This Act may be cited as the Ambulance Service Amendment Act 1996. 3 4 Commencement Clause 2. This Act commences on a day to be fixed by proclamation. 5 amended 6 Act Clause 3. This Act amends the Ambulance Service Act 1991. 7 of s 2 (Interpretation) 8 Amendment Clause 4.(1) Section 2, heading-- 9 omit, insert-- 10 `Definitions'. 11 (2) Section 2, definitions "board", "corporation", "director", 12 "employee of the board", "employee of a previous committee", "officer 13 of the Queensland Ambulance Service", "previous committee" and 14 "repealed Act"-- 15 omit. 16 (3) Section 2-- 17 insert-- 18 ` "appointed member" of the board see section 3I. 19 "approved superannuation scheme" means-- 20 (a) the Queensland Ambulance Service Superannuation Scheme; or 21 (b) another superannuation scheme approved by the Governor in 22 Council under section 17. 23 "board" means the service's board mentioned in section 3F. 24
s5 7 s5 Ambulance Service Amendment "conviction" includes a plea of guilty or a finding of guilt by a court even 1 though a conviction is not recorded. 2 "service" means the Queensland Ambulance Service. 3 "service officer" means a person employed under section 13(1).'. 4 (4) Section 2, definitions "commissioner" and "subscriber", 5 `Queensland Ambulance Service'-- 6 omit, insert-- 7 `service'. 8 of new pt 2, divs 1 and 2 and div 3 hdg 9 Insertion Clause 5. Part 2-- 10 insert-- 11 1--Queensland Ambulance Service 12 `Division of Queensland Ambulance Service 13 `Establishment `3A. The Queensland Ambulance Service is established. 14 of service 15 `Status `3B. The service-- 16 (a) is a body corporate with perpetual succession; and 17 (b) has a seal; and 18 (c) may sue and be sued in its corporate name. 19 represents the State 20 `Service `3C.(1) The service represents the State. 21 `(2) Without limiting subsection (1), the service-- 22 (a) has all the privileges and immunities of the State; and 23 (b) is an exempt public authority under the Corporations Law. 24
s5 8 s5 Ambulance Service Amendment functions 1 `Service's `3D. The functions of the service are-- 2 (a) to provide, operate and maintain ambulance services; and 3 (b) for ambulance services provided during rescue and other related 4 activities--to protect persons from injury or death, whether or not 5 the persons are sick or injured; and 6 (c) to provide transport for persons requiring attention at medical or 7 health care facilities; and 8 (d) to participate with other emergency services in counterdisaster 9 planning; and 10 (e) to coordinate all volunteer first aid groups for major emergencies 11 or disasters; and 12 (f) to adopt and put into effect all necessary measures (including 13 systems of planning, management and quality control) to best 14 ensure the efficient and economic operation and use of its 15 resources in providing ambulance services; and 16 (g) to provide casualty room services; and 17 (h) to provide community and workplace education in first aid, 18 cardiopulmonary resuscitation and other related matters; and 19 (i) to hold the property of each committee (other than money held in 20 trust and money raised by each committee) whether on or subject 21 to trusts or otherwise; and 22 (j) to identify and market products and services incidental to its other 23 functions; and 24 (k) to perform other functions given to the service under this Act or 25 another Act; and 26 (l) to perform functions incidental to its other functions. 27 powers 28 `Service's `3E.(1) The service has all the powers of an individual and may, for 29 example-- 30 (a) enter into contracts; and 31
s5 9 s5 Ambulance Service Amendment (b) acquire, hold, deal with and dispose of property; and 1 (c) appoint agents and attorneys; and 2 (d) charge for services and facilities it supplies; and 3 (e) undertake fundraising activities to benefit the service financially; 4 and 5 (f) do anything else necessary or convenient to be done for, or in 6 connection with, the performance of its functions. 7 `(2) Without limiting subsection (1), the service has the powers given to 8 it under this or another Act. 9 `(3) However, the service may exercise either of the following powers 10 only with the written approval of the Minister-- 11 (a) acquire land by purchase, lease or exchange; 12 (b) dispose of land by sale, lease, mortgage or in another way. 13 `(4) The service may exercise its powers inside and outside Queensland, 14 including outside Australia. 15 2--Service's board 16 `Division board 17 `The `3F. The service has a board. 18 of board 19 `Role `3G.(1) The board is responsible for the way the service performs its 20 functions and exercises its powers. 21 `(2) Without limiting subsection (1), it is the board's role-- 22 (a) to decide the objectives, strategies and policies to be followed by 23 the service; and 24 (b) to ensure the service performs its functions in an appropriate, 25 effective and efficient way. 26
s5 10 s5 Ambulance Service Amendment 1 Example of subsection 2(b)-- 2 The board could establish performance measures for the service. power to give directions 3 `Minister's `3H.(1) The Minister may give the board a written direction about the 4 administration, management and control of the service if the Minister is 5 satisfied it is necessary to give the direction in the public interest and 6 because of exceptional circumstances. 7 `(2) The board must ensure the direction is complied with. 8 `(3) Before giving the direction, the Minister must-- 9 (a) consult with the board; and 10 (b) ask the board to advise whether, in its opinion, complying with 11 the direction would not be in the service's financial interest. 12 `(4) The Minister must cause a copy of the direction to be gazetted within 13 21 days after it is given. 14 of board 15 `Membership `3I.(1) The board consists of-- 16 (a) the commissioner; and 17 (b) the chief commissioner of the Queensland Fire and Rescue 18 Authority; and 19 (c) the chief executive; and 20 (d) 5 other members. 21 `(2) The members of the board mentioned in subsection (1)(d) (the 22 "appointed members") are to be appointed by the Governor in Council. 23 `(3) However, a person may be appointed as an appointed member only 24 if the person has knowledge of, or experience in, matters relevant to the 25 service's functions. 26 `(4) The Governor in Council is to appoint one of the members of the 27 board as chairperson of the board. 28
s5 11 s5 Ambulance Service Amendment of office of appointed members 1 `Term `3J.(1) The appointment of an appointed member is for the term (not 2 longer than 3 years) decided by the Governor in Council. 3 `(2) The office of an appointed member becomes vacant if the 4 member-- 5 (a) resigns by signed notice of resignation given to the Minister; or 6 (b) is absent from 3 consecutive meetings of the board without the 7 board's leave and without reasonable excuse; or 8 (c) is convicted of an indictable offence; or 9 (d) becomes employed by, or a contractor of, the service; or 10 (e) is removed from office by the Governor in Council under 11 subsection (3) or (4). 12 `(3) The Governor in Council may remove an appointed member from 13 office if the member-- 14 (a) engages in misbehaviour; or 15 (b) becomes incapable of performing the duties of a member because 16 of physical or mental incapacity; or 17 (c) is incompetent; or 18 (d) does anything else that, in the Governor in Council's opinion, is a 19 reasonable justification for removal from office; or 20 (e) is convicted of an offence against this Act. 21 `(4) The Governor in Council may remove all or any of the appointed 22 members of the board from office if the board does not comply with a 23 direction given to it by the Minister under this Act. 24 and allowances of appointed members 25 `Remuneration `3K. An appointed member is entitled to be paid the remuneration and 26 allowances fixed by the Governor in Council. 27
s5 12 s5 Ambulance Service Amendment and place of meetings 1 `Time `3L.(1) Meetings of the board are to be held at the times and places it 2 decides. 3 `(2) However, the board must meet at least once every 3 months. 4 `(3) The chairperson of the board-- 5 (a) may at any time call a meeting of the board; and 6 (b) must call a meeting if asked by at least 4 members. 7 of proceedings 8 `Conduct `3M.(1) The chairperson of the board must preside at all board meetings 9 at which the chairperson is present. 10 `(2) If the chairperson is absent, the member chosen by the members 11 present must preside. 12 `(3) At a meeting of the board-- 13 (a) 5 members form a quorum; and 14 (b) a question is decided by a majority of the votes of the members 15 present and voting; and 16 (c) each member present has a vote on each question to be decided 17 and, if the votes are equal, the member presiding has a casting 18 vote. 19 `(4) The board may otherwise conduct its proceedings (including its 20 meetings) as it considers appropriate. 21 `(5) The board may hold meetings, or allow members to take part in 22 meetings, by telephone, closed circuit television or another form of 23 communication. 24 `(6) A member who takes part in a board meeting under subsection (5) is 25 taken to be present at the meeting. 26 `(7) A resolution is a valid resolution of the board, even though it is not 27 passed at a board meeting, if-- 28 (a) all members of the board give written agreement to the resolution; 29 and 30
s5 13 s5 Ambulance Service Amendment (b) notice of the resolution is given under procedures approved by the 1 board. 2 of documents 3 `Authentication `3N. A document made by the board for this Act is sufficiently made if it 4 is signed by the chairperson or a person authorised by the board. 5 of interests 6 `Disclosure `3O.(1) This section applies to a member of the board if-- 7 (a) the member has a direct or indirect financial interest in an issue 8 being considered, or about to be considered, by the board; and 9 (b) the interest could conflict with the proper performance of the 10 member's duties about the consideration of the issue. 11 `(2) As soon as practicable after the relevant facts come to the member's 12 knowledge, the member must disclose the nature of the interest to a meeting 13 of the board. 14 `(3) Unless the board otherwise directs, the member must not-- 15 (a) be present when the board considers the issue; or 16 (b) take part in a decision of the board on the issue. 17 `(4) The member must not be present when the board is considering 18 whether to give a direction under subsection (3). 19 `(5) If there is another person who must, under subsection (2), also 20 disclose an interest in the issue, the other person must not-- 21 (a) be present when the board is considering whether to give a 22 direction under subsection (3); or 23 (b) take part in making the decision about giving a direction. 24 `(6) If, because of this section, a member is not present at a board 25 meeting for considering or deciding an issue, but there would be a quorum 26 if the member were present, the remaining members present are a quorum 27 for considering or deciding the issue at the meeting. 28
s6 14 s8 Ambulance Service Amendment `(7) A disclosure under subsection (2) must be recorded in the board's 1 minutes. 2 inutes 3 `M `3P. The Governor in Council may appoint a person to act in the office 10 of commissioner during-- 11 (a) any vacancy, or all vacancies, in the office; or 12 (b) any period, or all periods, when the commissioner is absent from 13 duty, or cannot, for another reason, perform the functions of the 14 office.'. 15 mission of ss 7 and 8 16 O Clause 7. Section 9-- 21 omit, insert-- 22 of commissioner 23 `Role `9.(1) The commissioner is responsible for managing the service's 24 operations in accordance with its objectives, strategies and policies. 25
s9 15 s 10 Ambulance Service Amendment `(2) Without limiting subsection (1), the commissioner is to prepare an 1 annual corporate plan incorporating performance targets developed in 2 consultation with the board and approved by the Minister. 3 `(3) The commissioner has power to do anything necessary or 4 convenient to be done for, or in connection with, the management of the 5 service's operations.'. 6 of ss 10-12 7 Omission Clause 9. Sections 10 to 12-- 8 omit. 9 of s 17 (Superannuation scheme) 10 Replacement Clause 10. Section 17-- 11 omit, insert-- 12 scheme 13 `Superannuation `17.(1) The Governor in Council may approve a superannuation scheme 14 (other than the Queensland Ambulance Service Superannuation Scheme) 15 for service officers or classes of service officers. 16 `(2) Every service officer (other than an honorary ambulance officer) 17 must become a contributor to an approved superannuation scheme (if the 18 officer is otherwise eligible under the terms of the scheme) and, while a 19 service officer, must continue to contribute to the scheme in accordance 20 with its terms. 21 `(3) A service officer who becomes a public service officer must, by 22 written notice given to the commissioner within 2 months after starting 23 employment with the public service, elect-- 24 (a) to continue to contribute to an approved superannuation scheme; 25 or 26 (b) to contribute to the superannuation scheme to which persons who 27 become public service officers after the commencement of this 28 section would usually contribute.'. 29
s 11 16 s 11 Ambulance Service Amendment of new pt 2, div 4 1 Insertion Clause 11. Part 2, after section 18-- 2 insert-- 3 4--Other matters about the service 4 `Division 5 `Finance `19.(1) Before the start of each financial year, the commissioner must 6 give to the board a budget for the service showing the estimated receipts and 7 disbursements for the year. 8 `(2) The board is to approve the budget-- 9 (a) as given by the commissioner; or 10 (b) as amended in the way the board considers appropriate. 11 `(3) The Minister may specify terms and conditions under which a 12 budget may be amended. 13 `(4) A budget approved under subsection (2) and, if appropriate, 14 amended under subsection (3), is to be the budget for the service for the 15 financial year for which it is prepared. 16 `(5) The service is to observe the budget for each financial year. 17 of certain Acts 18 `Application `20. The service is-- 19 (a) a unit of public administration under the Criminal Justice Act 20 1989; and 21 (b) an agency under the Equal Opportunity in Public Employment 22 Act 1992; and 23 (c) a public authority under the Libraries and Archives Act 1988; and 24 (d) a statutory body under the Statutory Bodies Financial 25 Arrangements Act 1982. 26
s 12 17 s 14 Ambulance Service Amendment 1 `Seal `21. Judicial notice must be taken of the imprint of the service's seal 2 appearing on a document, and the document must be presumed to have 3 been properly sealed unless the contrary is proved. 4 5 `Delegations `22.(1) The service may delegate its powers under this Act to the 6 commissioner or an appropriately qualified service officer. 7 `(2) The commissioner may delegate the commissioner's powers under 8 this Act to an appropriately qualified service officer. 9 `(3) In subsections (1) and (2)-- 10 "appropriately qualified" includes having the qualifications, experience or 11 standing appropriate to exercise the power. 12 13 Example of `standing'-- 14 A person's classification level in the service.'. of pt 3 (The Corporation) 15 Omission Clause 12. s 15 18 s 16 Ambulance Service Amendment `PART 8--SAVINGS AND TRANSITIONAL 1 PROVISIONS'. 2 of new s 54A 3 Insertion Clause 15. Part 8-- 4 insert-- 5 6 `Definitions `54A. In this part-- 7 ` "amendment Act" means the Ambulance Service Amendment Act 1996. 8 "commencement" means the commencement of the amendment Act, 9 section 5. 10 "corporation" means the corporation sole under this Act as in force 11 immediately before the commencement. 12 "former service" means the Queensland Ambulance Service in existence 13 immediately before the commencement. 14 "transferred officer" means a person taken to be employed as an 15 ambulance, medical or administrative officer of the service under 16 section 61, 62 or 63.'. 17 of s 56 (References to the board and previous 18 Amendment committees) 19 Clause 16.(1) Section 56, `the corporation, the Queensland Ambulance 20 Service'-- 21 omit, insert-- 22 `the service'. 23 (2) Section 56-- 24 insert-- 25 `(2) In subsection (1)-- 26 "board" means the Queensland Ambulance Services Board constituted 27 under the Ambulance Services Act 1967, section 6. 28

A person who, immediately before the commencement, was 4 employed as an administrative or service officer of the former service is, on 5 the commencement, taken to be employed as an administrative officer of 6 the service. 7 of employment of transferred officers 8 `Conditions `64.(1) The conditions of employment applying to a transferred officer 9 must be no less favourable than the conditions that applied to the officer 10 immediately before the commencement. 11 `(2) A transferred officer remains entitled to all rights accrued or accruing 12 to the officer as an employee of the former service. 13 `(3) Without limiting subsection (2), a transferred officer is entitled to 14 receive annual, sick and long service leave and any similar entitlements 15 accrued or accruing to the officer as an employee of the former service. 16 `(4) The recognised service of a transferred officer is taken to be service 17 as an employee of the service for the purpose of any law dealing with rights 18 or entitlements mentioned in this section. 19 `(5) In subsection (4)-- 20 "recognised service" of a transferred officer means the officer's service as 21 an employee of the former service, and includes any previous service 22 of the officer taken to be service with the former service. 23 ambulance officers 24 `Honorary `65. A person who, immediately before the commencement, was an 25 honorary ambulance officer with the former service is taken to be appointed 26 as an honorary ambulance officer for the service. 27
