2015 A Bill for An Act to amend the Constitution of Queensland 2001 and the Electoral Act 1992 for particular purposes
Electoral (Improving Representation) and Another Act Amendment Bill 2015 Part 1 Preliminary [s 1] The Parliament of Queensland enacts-- 1 Part 1 Preliminary 2 Clause 1 Short title 3 This Act may be cited as the Electoral (Improving 4 Representation) and Another Act Amendment Act 2015. 5 Clause 2 Commencement 6 (1) Part 2 commences immediately after the first 7 post-redistribution writ is issued. 8 (2) In this section-- 9 2016 electoral redistribution means the first electoral 10 redistribution under the Electoral Act 1992 that becomes final 11 under that Act after the commencement of part 3. 12 Note-- 13 For electoral redistributions, see the Electoral Act 1992, part 3. 14 first post-redistribution writ means the writ for the general 15 election first issued under the Electoral Act 1992, section 82 16 after the 2016 electoral redistribution has become final. 17 Part 2 Amendment of Constitution of 18 Queensland 2001 19 Clause 3 Act amended 20 This part amends the Constitution of Queensland 2001. 21 Page 4
Electoral (Improving Representation) and Another Act Amendment Bill 2015 Part 3 Amendment of Electoral Act 1992 [s 4] Clause 4 Amendment of s 11 (Number of members of Legislative 1 Assembly) 2 Section 11, '89'-- 3 omit, insert-- 4 93 5 Part 3 Amendment of Electoral Act 6 1992 7 Clause 5 Act amended 8 This part amends the Electoral Act 1992. 9 Clause 6 Amendment of s 2 (Definitions) 10 Section 2-- 11 insert-- 12 bipartisan support, of the parliamentary 13 committee, means-- 14 (a) support of the members of the parliamentary 15 committee unanimously; or 16 (b) support of a majority of the members, other 17 than a majority consisting wholly of 18 members of the political party or parties in 19 government in the Legislative Assembly. 20 Clause 7 Amendment of s 3 (Average number of enrolled electors 21 for electoral districts) 22 Section 3(1), definition average number of enrolled electors for 23 electoral districts, '89'-- 24 omit, insert-- 25 Page 5
Electoral (Improving Representation) and Another Act Amendment Bill 2015 Part 3 Amendment of Electoral Act 1992 [s 8] 93 1 Clause 8 Amendment of s 6 (Establishment of Electoral 2 Commission of Queensland etc.) 3 (1) Section 6(6), from 'be'-- 4 omit, insert-- 5 be a person with qualifications and experience in 6 applied demography relevant to contemporary 7 electoral redistributions. 8 (2) Section 6(7)-- 9 omit, insert-- 10 (7) A person may be appointed as the chairperson or 11 nonjudicial appointee only if the person's 12 appointment is made with the bipartisan support 13 of the parliamentary committee. 14 Clause 9 Amendment of s 22 (Terms and conditions of 15 appointment etc.) 16 Section 22(2)-- 17 insert-- 18 (c) the person's appointment is made with the 19 bipartisan support of the parliamentary 20 committee. 21 Clause 10 Amendment of s 34 (Number of electoral districts for the 22 State) 23 Section 34, '89'-- 24 omit, insert-- 25 93 26 Page 6
Electoral (Improving Representation) and Another Act Amendment Bill 2015 Part 3 Amendment of Electoral Act 1992 [s 11] Clause 11 Amendment of s 35 (Distribution, and redistribution, of 1 State into electoral districts) 2 Section 35(3), '89'-- 3 omit, insert-- 4 93 5 Clause 12 Amendment of s 52 (When redistribution takes effect) 6 (1) Section 52(1), after 'subject to'-- 7 insert-- 8 subsection (3) and 9 (2) Section 52(2), 'The'-- 10 omit, insert-- 11 Subject to subsection (3), the 12 (3) Section 52-- 13 insert-- 14 (3) For the 2016 electoral redistribution-- 15 (a) there is no increase in the number of 16 members of the Legislative Assembly; and 17 (b) the electoral districts, as in existence before 18 the redistribution, continue in force; 19 until the first post-redistribution writ is issued 20 and any appeal under section 57(6) has been 21 disposed of by the Court of Appeal. 22 (4) Subsection (3) has effect despite the Constitution 23 of Queensland 2001, sections 12 and 13. 24 (5) In this section-- 25 2016 electoral redistribution means the first 26 electoral redistribution that becomes final after 27 the commencement of the Electoral (Improving 28 Representation) and Another Act Amendment Act 29 2015, part 3. 30 Page 7
