An Act to amend the Guide, Hearing and Assistance Dogs Act
2009 to provide for rights and obligations relating to guide,
hearing and assistance dogs in places of accommodation

The Parliament of Queensland enacts-- 1
Clause 1 Short title 2
This Act may be cited as the Guide, Hearing and Assistance 3
Dogs (Places of Accommodation) Amendment Act 2013. 4

This Act amends the Guide, Hearing and Assistance Dogs Act 6
2009. 7

(a) a person with a disability who is 1
accompanied by the certified guide, hearing 2
or assistance dog the person relies on to 3
reduce the person's need for support; or 4
(b) an approved trainer, employee trainer or 5
puppy carer who is accompanied by a guide, 6
hearing, assistance or trainee support dog. 7
certified guide, hearing or assistance dog means 8
a guide, hearing or assistance dog that is certified 9
under part 4. 10
place of accommodation includes-- 11
(a) a house or flat; and 12
(b) a hotel or motel; and 13
(c) a boarding house or hostel; and 14
(d) a caravan or caravan site; and 15
(e) a manufactured home under the 16
Manufactured Homes (Residential Parks) 17
Act 2003; and 18
(f) a site within the meaning of the 19
Manufactured Homes (Residential Parks) 20
Act 2003, section 13; and 21
(g) a camping site. 22
term includes a condition, requirement or 23
practice, whether or not written. 24

(1) A person exercising control of a place of 11
accommodation must not-- 12
(a) refuse to accept a reservation or application 13
at the place for accommodation for an 14
accompanied handler because the 15
accompanied handler is accompanied by a 16
guide, hearing, assistance or trainee support 17
dog; or 18
(b) refuse to enter into or fulfil an agreement to 19
provide accommodation at the place for an 20
accompanied handler because the 21
accompanied handler is accompanied by a 22
guide, hearing, assistance or trainee support 23
dog; or 24
(c) refuse to renew or extend the supply of 25
accommodation for an accompanied handler 26
at the place because the accompanied 27
handler is accompanied by a guide, hearing, 28
assistance or trainee support dog; or 29
(d) impose a term as part of an agreement to 30
provide accommodation for an accompanied 31
handler at the place because the 32
accompanied handler is accompanied by a 33

guide, hearing, assistance or trainee support 1
dog. 2
Maximum penalty--100 penalty units. 3
(2) Subsection (1) applies only in relation to an 4
accompanied handler complying with the 5
identification procedure. 6
(3) Also, subsection (1)(d) does not apply to a term 7
about the guide, hearing, assistance or trainee 8
support dog entering a part of the place where 9
food is ordinarily prepared for consumption by 10
other residents at the place or members of the 11
public. 12
(4) It is a defence to a charge of an offence against 13
subsection (1) for the person to prove that he or 14
she contravened this section for a reason that-- 15
(a) was reasonable in the circumstances; and 16
(b) did not relate to the accompanied handler 17
being accompanied by a guide, hearing, 18
assistance or trainee support dog. 19
Note-- 20
A person with a disability may also have a right of action 21
under the Disability Discrimination Act 1992 (Cwlth). 22
