1993 A BILL FOR An Act to amend the Liquor Act 1992

 


 

4 Liquor Amendment (No. 2) The Parliament of Queensland enacts-- 1 title 2 Short Clause1. This Act may be cited as the Liquor Amendment Act (No. 2) 1993. 3 Act 4 Amended The Liquor Act 1992 is amended as set out in this Act. 5 Clause2. of s.139 (Compensation not payable) 6 Amendment Section 139(2)-- 7 Clause3. omit. 8 of s.151 (Unlawful betting or gaming) 9 Amendment Section 151(2)-- 10 Clause4. omit `an entertainment machine within the meaning of the Art Unions 11 and Amusements Act 1976', 12 insert `a public amusement within the meaning of the Art Unions and 13 Public Amusements Act 1992'. 14 of s.222 (Application of Trust Fund) 15 Amendment Section 222(1)-- 16 Clause5. omit, insert-- 17 `222.(1) The amount standing to the credit of the Trust Fund may be 18 applied to programs directed to-- 19 (a) discouraging intemperance; or 20 (b) preserving the health of the community and its members against 21 alcoholism; or 22 (c) emphasising the dangers of consumption of liquor to users of the 23

 


 

5 Liquor Amendment (No. 2) roads; or 1 (d) establishing or continuing culturally appropriate detoxification 2 centres and other therapeutic facilities for persons suffering 3 problems from liquor consumption; or 4 (e) continuing and enhancing education and training in patron care; or 5 (f) furthering development of appropriate components in the 6 curricula of hospitality training courses.'. 7 of s.223 (Supplementary payments to Trust Fund) 8 Replacement Section 223-- 9 Clause6. omit, insert-- 10 payments to Trust Fund 11 `Supplementary `223. If, in a financial year, the balance to the credit of the Trust Fund 12 falls below $2 000 000, the Treasurer may, by order, pay into the Trust 13 Fund from the total amount of fees paid for all licences and permits 14 throughout the year-- 15 (a) one-sixteenth of the total; or 16 (b) if a lesser amount is enough to restore the balance to the credit of 17 the Trust Fund to $2 000 000--the lesser amount.'. 18 of s.236 (Objects of Part) 19 Replacement Section 236-- 20 Clause7. omit, insert-- 21 of Part 22 `Object `236. The object of this Part is to provide for transition from the repealed 23 Act to the current Act.'. 24 of s.245 (Continuance of business of brewers etc.) 25 Omission Section 245-- 26 Clause8. omit. 27

 


 

6 Liquor Amendment (No. 2) of Part 11, Division 3 (Compensation for surrendered 1 Replacement general licences) 2 Part 11, Division 3-- 3 Clause9. omit, insert-- 4 for certain surrendered general licences 5 `Compensation `250. This Act, as in force immediately before the commencement of the 6 Liquor Amendment Act (No. 2) 1993, continues to apply to a request to the 7 chief executive to accept the surrender of a general licence if, before the 8 commencement-- 9 (a) the request was received; and 10 (b) section 250 as then in force applied to the request; and 11 (c) matters under the Act about the request were not finalised.'. 12 13 � State of Queensland 1993
